LA Minutes 11-27-2012TOWN OF AVON, COLORADO MINUTES OF THE LOCAL LIQUOR LICENSING AUTHORITY MEETING NOVEMBER 27, 2012 The Avon Town Council acting as the Local Liquor Licensing Authority for the Town of Avon, Colorado convened at 5:00 PM at the Avon Town Hall, One Lake Street, Avon, Colorado. A roll call was taken and Board members of the Authority present were Rich Carroll, Dave Dantas, Chris Evans, Kristi Ferraro, Todd Goulding, Amy Phillips and Buz Reynolds. 1. PUBLIC HEARINGS FOR NEW LIQUOR LICENSES a. Applicant: Red Mountain Grill Avon LLC, d /b /a Red Mountain Grill Avon Address: 240 Chapel Place, Unit B123 Manager: Steven Edward Kaufman Type: Hotel and Restaurant Liquor License Eric Heil, Town Attorney, provided some information regarding parameters in which to consider new liquor license applications, including a review of the need to evaluate moral character of the applicants. Chairman Carroll asked if the application materials were in order; Acting Town Manger Patty McKenny noted that all materials were submitted. Steve Kaufman was present to introduce himself as the owner and available to answer questions. Board member Goulding moved to approve the hotel and restaurant liquor license for Red Mountain Grill Avon LLC, d /b /a Red Mountain Grill Avon; Board member Phillips seconded the motion and it passed unanimously. Chairman Carroll opened the public hearing, no comments were made, and the public hearing was closed. b. Applicant: Blackstar LLC, d /b /a FOOD! By Marc Address: 137 Benchmark Road 4W Manager: Marc Rouse Type: Hotel and Restaurant Liquor License Resolution No. 12 -03, Series of 2012, Resolution Approving the Application of Blackstar LLC d /b /a FOOD! By Marc for a Hotel and Restaurant Liquor License Chairman Carroll asked if the application materials were in order; Acting Town Manger Patty McKenny noted that all materials were submitted. Chairman Carroll opened the public hearing, no comments were made, and the public hearing was closed. Marc Rouse was present to introduce himself as the owner and was available to answer questions. JT Thompson, former employer of Mr. Rouse, was present to express his support of the applicant as well as the restaurant. Board member Goulding moved to approve the hotel and restaurant liquor license for Blackstar LLC, d /b /a FOOD! By Marc; Board member Dantas seconded the motion and it passed unanimously. SHOW CAUSE HEARING ON LIQUOR LICENSE VIOLATION — CONTINUED UNTIL DECEMBER 11, 2012 a. Stipulated Findings of Fact, Conclusions and Sanctions Order Avon Police Incident Case Report No. 2012 - 000748 dated September 20, 2012 Establishment Name: China Garden, Inc. d /b /a China Garden Address: 100 W. Beaver Creek Place Manager: Sharon Mou Type: Hotel and Restaurant Liquor License Chairman Carroll noted that the owner of China Garden, Sharon Mou, requested through her attorney a continuance on the hearing until December 11, 2012. Board member Goulding moved to continue he public hearing until such date; Board member Dantas seconded the motion and it passed unanimously CONSENT AGENDA: a. Minutes from November 13, 2012 Chairman Carroll asked for a motion on the consent agenda. Board member Phillips moved to approve the minutes from November 13; Board member Reynolds seconded the motion and it passed unanimously. There being no further business to come before the Board, the meeting adjourned at 5:20 PM.
