PZC Res No. 2014-03TOWN OF AVON, COLORADO PLANNING COMMISSION RESOLUTION 14 -03 o /\i / n SERIES OF 2014 !� V V F­ _ A RESOLUTION RECOMMENDING DENIAL OF A MINOR PUD AMENDMENT APPLICATION TO PERMIT SHORT TERM RENTALS (STR) IN THE WILDRDIGE SUBDIVISION DURING THE 2015 ALPINE WORLD SKI CHAMPIONSHIPS WHEREAS, Harry Greenberg, the Applicant, submitted an Application to permit STR's (i.e. rentals less than 3o days) in the Wildridge Subdivision and PUD from January 30, 2015 to February 21, 2015 ; and WHEREAS, the Planning & Zoning Commission of the Town of Avon held a public hearing on July 1, 2014, after publishing and posting notice as required by law, considered all public comments, testimony, evidence and staff reports provided by the Town staff, considered such information prior to formulating a recommendation on the Application; WHEREAS, the Planning & Zoning Commission finds the Application does not comply with the review criteria set forth in §7.16.006o(d)(4), PUD Review Criteria, Avon Municipal Code; and, NOW THEREFORE, BE IT RESOLVED, that the Planning and Zoning Commission hereby recommends that the Town Council of the Town of Avon Deny the Minor PUD Amendment Application (Case #PUD14002) pursuant to the following findings: 1. There is no viable method of regulating STR's to ensure safety and building inspections. 2. No evidence pointing to the lack of STR's in the region was provided with the application. 3. With absentee owners for STR's there is no way to address concerns or issues in a timely fashion if they come up. 4. The dwelling units in Wildridge were constructed for long -term residential use and may not have the appropriate life safety devices (i.e. carbon monoxide detectors). 5. No clear benefit to the Town of Avon to allowing STR's in Wildridge.
