HELD JUNE 29, 2012
A special council meeting of the Town of Avon, Colorado was held at the Avon Town Hall, One Lake
Street, Avon, Colorado in the Council Chambers.
Mayor Carroll called the meeting to order at 8:10 AM. A roll call was taken and Council members
present were Dave Dantas, Chris Evans, Kristi Ferraro, Todd Goulding, Amy Phillips and Buz Reynolds.
Also present were Town Attorney Eric Heil, Acting Town Manager Patty McKenny, and Town Advisor
Larry Brooks.
ORDINANCES
Public Hearing on Ordinance No. 12 -08, Series of 2012, Emergency Ordinance Amending Chapter
8.16 of the Avon Municipal Code, Enacting Immediate Fire Ban in the Town of Avon and Imposing
Penalties for Violation Thereof
Eric Heil, Town Attorney, presented the emergency ordinance that enacts an immediate fire ban in the
Town of Avon in light of many factors that have led to an extreme fire danger environment. He noted
that this legislation was appropriate in light of the town position of adopting fire ban restrictions that
are consistent with the County and ERFPD. He also noted that a violation of this ordinance would be
deemed a criminal infraction punishable under the Code's Chapter 1.08. Mayor Carroll opened the
public hearing, no comments were made, and the hearing was closed. The Town Council requested
that signage be placed around town and at trailheads. Councilor Evans moved to approve Ordinance
No. 12 -08, Series of 2012, Emergency Ordinance Amending Chapter 8.16 of the Avon Municipal Code,
Enacting Immediate Fire Ban in the Town of Avon and Imposing Penalties for Violation Thereof.
Councilor Phillips seconded the motion and it passed unanimously
EXECUTIVE SESSION (THIS SESSION IS NOT OPEN TO THE PUBLIC)
Councilor Phillips moved to convene into an Executive Session to meet with the Town Attorney for the
purpose of receiving legal advice to specific legal questions pursuant to Colorado Revised Statute §24-
6-402(4)(b) related to the pending litigation with Traer Creek LLC and Traer Creek Metropolitan District.
Mayor Pro Tern Ferraro seconded the motion and it passed unanimously.
There being no further business to come before the Council, the executive session and special meeting
adjourned at 9:10 AM.
