A RESOLUTION REPEALING RESOLUTION 11 -09 AND APPROVING A NEW
RESOLUTION BY THE AVON TOWN COUNCIL SUPPORTING A MULTI -PARTY
LAND EXCHANGE LOCATED IN THE WHITE RIVER FOREST IN EAGLE COUNTY
AND RECOMMENDING EXCEPTIONS TO THE CONSERVATION EASEMENTS ON
THE AVON WEST PARCEL AND THE FOREST SERVICE VILLAGE PARCEL
WHEREAS, the White River National Forest — Eagle/Holy Cross Ranger District has initiated a
multi -party land exchange involving Eagle County, the Colorado State Land Board, the Upper
Eagle Regional Water Authority, and the United State Forest Service (USFS); and
WHEREAS, the Town of Avon may acquire two National Forest parcels resulting from the land
exchange: a) The West Avon Parcel containing approximately 478.09 acres within the Town of
Avon; and b) The Forest Service Village Parcel, containing approximately 85.99 acres in Eagle
County (collectively the "USFS Parcels "); and
WHEREAS, a Conservation Easement held by the Eagle Valley Land Trust shall be established
on the USFS Parcels for the purpose of preserving publically accessible open space and limited
recreational uses; and
WHEREAS, the Town may request suitable uses as exceptions to the Conservation Easements;
and
WHEREAS, the Avon Comprehensive Plan adopted in 2006, recommends that the USFS
Parcels be preserved for open space and limited recreational uses and to provide a visual and
physical community separator between Avon and Singletree; and
WHEREAS, Resolution No. 07 -29, adopted by the Town Council on August 14, 2007, initiated
the acquisition of the USFS Parcels for the purpose of providing permanent protection of open
space and recreational uses located near the Town of Avon; and
WHEREAS, the Town Council held public hearings on May 10, 2011 and July 12, 2011 to
consider the Town participation in the land exchange and suitable exceptions to the Conservation
Easements, and has determine that the citizens of Avon want the USFS Parcels preserved for
publically accessible open space and limited recreation uses; and
WHEREAS, the physical characteristics of both USFS Parcels, including steep slopes in excess
of 40 percent, prohibit or significantly restrict the construction of access roads, retaining walls
and infrastructure on these parcels in accordance with the Town's zoning and subdivision
standards; and
WHEREAS, the Avon Town Council cannot determine at this time with the information
available whether the design of a vehicle access through the Forest Service Village Parcel from

RMF -1 to Planning Area M of the Village (at Avon) PUD from Highway 6 is viable, whether
acceptable alternative designs or alignments are possible, whether vehicle access through the
Forest Service Village Parcel presents a better design and planning option than other potential
road alignments, or whether additional road access improvements to Planning Area M are
desired or required, and furthermore, the Avon Town Council does not have information
regarding development plans, if any, for Planning Area M other than general uses described in
the Village (at Avon) PUD Guide; and
WHEREAS, the development of affordable housing and community facilities in the northwest
corner of the Forest Service Village East Parcel may be compatible with the Town's goals and
policies.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF AVON, COLORADO, the following:
Section 1. Resolution 11 -09 approved by the Avon Town Council on May 24, 2011 is hereby
repealed in its entirety.
Section 2. Acquisition of the USFS Parcels is consistent with the goals and policies of the Avon
Comprehensive Plan and necessary for the safe and orderly development of the Town.
Section 3. The following uses described below and depicted on Exhibits A, B and C of this
Resolution and attached hereto are consistent with the Avon Comprehensive Plan and its guiding
policies, and the recommendations of the Site Suitability Analysis prepared by the Avon
Community Development Department, and should therefore be reserved as exceptions to the
Conservation Easements that will encumber the USFS Parcels:
A. Avon West Town Parcel. (Exhibit A)
i. The trail alignments and associated improvements recommended in the Avon
Recreational Trails Master Plan (2009).
ii. A conceptual alignment for a paved trail and associated improvements extending from
Nottingham Rd north to the June Creek Trail.
B. Forest Service Village Parcel (Exhibits B and C)
i. The "Core Trail" alignment recommended in the Eagle Valley Regional Trails Plan (Dec
2001).
ii. Trail alignments which follow existing wildlife corridors and old ranching /jeep roads.
iii. Connector trails to Hwy 6 and the I- 70/Post Blvd interchange area.
iv. 6.2 contiguous acres in the NW corner of the parcel for affordable housing and
community facilities.

V. A potential future easement or easements for a road and trail connecting Planning Area
RMF -1 to Planning Area M, Village (at Avon), Avon, Colorado, provided that any such
road and/or trail easement shall be subject to future review and approval by the Avon
Town Council and Avon Planning and Zoning Commission as appropriate and shall
require (1) amendments to the Avon Comprehensive Plan, including Avon's 3 -Mile Plan,
Major Streets Plan and Transportation Plan, (2) an amendment to the Village (at Avon)
PUD Plan, (3) an application for road construction in accordance with the procedures and
standards of the Avon Development Code and Avon Municipal Code, and (4)
consideration of equitable compensation to the Town of Avon regarding the Town of
Avon's financial expenditure to acquire the Forest Service Village Parcel.
Section 3. The Town Manager is directed to work with the Eagle Valley Land Trust to provide
sufficient detail concerning the location and extent of the above - described exceptions to the
Conservation Easements.

the Forest Service Village East Parcel may be compatible with the Town's goals and policies.

Summary

May 24, 2011.
The Resolution was forwarded to all parties participating in the land exchange, including the Eagle
County Commissioners, the Eagle/Holy Cross Ranger District and the Colorado State Land Board.
After reviewing the Resolution the State Land Board requested that several modifications be made to the
recitals clarifying that the Town will acquire the two National Forest parcels from the US Forest Service,
and that Eagle County is also a party in the land exchange.
Resolution 11-12 repeals Resolution 11-09 and includes the corrections requested by the State Land
Board. A redlined copy of Resolution 11-12 is attached.
