No. 2012-22 Delinquent Charges Collected by ECTMemo To: Honorable Mayor and Town Council Thru: Scott Wright, Finance Director From: Valerie Barry, Finance Manager Kelly Huitt, Budget Analyst Date: November 15, 2012 Re: Certification of Past Due Amounts to Eagle County Summary: as� Attached is resolution #12 -22 which details delinquent charges to be certified and collected by the Eagle County Treasurer. Background: Exhibit A The driveway at 5080 Wildridge Road was in a state of disrepair and the owner was given notice to fix the unsafe condition. After no response from the owner staff began formal abatement procedures to correct the unsafe conditions in the driveway. The total cost incurred by the Town for the construction of $14,750.80 was invoiced to the owner. When payment of the invoice was not received, a lien was placed on the property and the amount due plus penalties, interest and fees can now be certified to the County for collection on their tax rolls. Exhibit B The real estate transfer tax due on the purchase of Seasons at Avon Residential Condominiums Unit # 308 was never received. A letter was sent out to the owner notifying them of the past due amount of $3,240 and describing the process that would occur if payment was not remitted. The owner filed for a full exemption that was denied. Our attorneys sent out a formal denial letter which informed the owner that they had 30 days to file an appeal to the Town Council, and that failure to receive a written request for appeal within 30 days shall be deemed to be a waiver of any right to appeal the decision of the Town Manager. A written appeal was not received, nor was payment made for the delinquent real estate transfer tax. A lien will be placed on the property for the original amount due plus penalty, interest, and fees, and this amount can now be certified to the County for collection on their tax rolls. Page 1 Recommendation: It is recommended that Council adopt the resolution certifying past due accounts to be collected on the Eagle County Tax rolls.
