No. 2007-18 APPROVING THE SECOND AMENDMENT TO THE CONDOMINIUMTOWN OF AVON, COLORADO RESOLUTION NO. 07-18 Series of 2007 A RESOLUTION APPROVING THE SECOND AMENDMENT TO THE CONDOMINIUM MAP FOR WESTGATE, A RESUBDIVISION OF LOT 3, BLOCK -3, BENCHMARK AT BEAVER CREEK, TOWN OF AVON, EAGLE COUNTY, COLORADO WHEREAS, Elk Meadow, Inc., a Colorado Corporation, c/o Wear, Travers, & Perkins, P.C., on behalf of Gretchen McNamee and William Michael Larson, has applied for approval of the Second Amendment to the Condominium Map for Westgate, A Resubdivision of Lot 3, Block 3, Benchmark at Beaver Creek, in the Town of Avon, Eagle County Colorado, in accordance with Chapter 16 of the Avon Municipal Code; and WHEREAS, the Second Amendment to the Condominium Map has been reviewed by the Town Staff-, and WHEREAS, the Second Amendment to the Condominium Map was found to be substantially in conformance with Title 16 of the -Avon Municipal Code; and WHEREAS, the Second Amendment to the Condominium Map is consistent with previous condominium maps recorded for the property; and WHEREAS, the proposed subdivision complies with the requirements for consideration as at Final Plat. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COLORADO, that the Town hereby finds and determines that the proposed Second Amendment to the Condominium Map for Westgate is in the best interest of the public health,, safety and welfare,- and other applicable development laws, regulations and policies of the Town of Avon and hereby approves the same subject to compliance with the following condition: . 1. To: Honorable Mayor and Town Council Thru: Larry Brooks, Town Manager From: Norman Wood, Town Engineer Jeffrey Schneider, Engineer H Date: May 16, 2007 Re: Resolution No. 07-18 - A Resolution Approving the Second Amendment to the Condominium Map for Westgate, A Resubdivision of Lot 3, Block 3, Benchmark at Beaver Creek, Town of Avon, Eagle County, Colorado (1060 West Beaver Creek Boulevard) Summary: Elk Meadow, Inc., a Colorado Corporation, c/o Wear, Travers, and Perkins, P.C., on behalf of Gretchen McNamee and William Michael Larson, has submitted an application for a Second Amendment to the Condominium Map for Westgate, a Resubdivision of Lot 3, Block 3, Benchmark at Beaver Creek, Town of Avon, Eagle County, Colorado, located at 1060 West Beaver Creek Boulevard. The proposed subdivision will reconfigure the condominium walls between units 201 and 202, owned by Gretchen McNamee and William Michael Larson, respectively. Resolution 07-18 (Exhibit 1) approves the proposed Second Amendment to the Condominium Map for Westgate subject to completion of Technical Corrections as identified by Staff. We recommend approval of Resolution No. 07-18, A Resolution Approving the Second Amendment to the Condominium Map for Westgate, A Resubdivision of Lot 3, Block 3, Benchmark at Beaver Creek, Town of Avon, Eagle County, Colorado. Discussion: The purpose of the proposed subdivision is to reconfigure the condominium walls between Units 201 and 202 of Westgate. The wall was physically relocated by the owner of both units several years ago. The units were both leased at the time of wall relocation. This subdivision application is to adjust the condominium maps and adjust the declarations since the two affected units have now been sold to two separate parties. The Second Amendment to the Condominium Map is consistent with the previous Condominium Maps for the property. The submitted Second Amendment to the Condominium Map is in general conformance with the requirements set forth in Title 16 of the Avon Municipal Code, Subdivisions, and complies with the requirements for consideration as a Final Plat. Financial Implications: There are no financial implications associated with the granting or denial of this Final Condominium Map. Recommendation: Approve of Resolution No. 07-18, A Resolution Approving the Second Amendment to the Condominium Map for Westgate, A Resubdivision of Lot 3, Block 3, Benchmark at Beaver Creels, Town of Avon, Eagle County, Colorado.
