A' RESOLUTION APPROVING THE AMENDED FINAL PLAT, THE VILLAGE AT
AVON FILING 3,'A RECONFIGURATION OF TRACTS B AND F, TOWN OF AVON,
EAGLE COUNTY, COLORADO
WHEREAS, Traer Creek-RP LLC has filed an Amended Final Plat for The Village at
Avon Filing 3, Town of Avon, Eagle County, Colorado; and
WHEREAS, the Amended Final Plat has been reviewed by the Town Staff, and
WHEREAS, the Amended Final Plat was found to be substantially in conformance with
Title 16 of the Avon Municipal Code; and
WHEREAS, the Amended Final Plat is subject to the terms and. conditions of the
Annexation and Development Agreement dated October 13, 1998 and any amendments or
modifications thereto; and
WHEREAS, the Amended Final Plat is subject to the terms and conditions of the P.U.D.
Guide and P.U.D. Development / Sketch Plan dated October 13, 1998 and any amendments or
modifications thereto; and
WHEREAS, the Amended Final Plat is in general conformance with Town of Avon
Ordinance 06-16, Series of 2006, an Ordinance Approving, with Conditions, a PUD Amendment
Application Amending the Village at Avon PUD to Permit Emergency Service Uses within
Planning Area N; Filing 3, the Village at Avon Subdivision;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF AVON, COLORADO, that the Amended Final Plat for The Village at Avon Filing 3, a
Reconfiguration. of Tracts. B and F, Town of Avon, Eagle County, Colorado, is hereby approved
by the Town.of Avon subject to:
A. Completion of technical corrections as identified by Town Staff.

• Traer Creek-RP LLC has submitted an Amended Final Plat for the ' Village' (at Avon) .
Filing 3. This is a reconfiguration of a previously subdivided parcel of land located in the
Southeast '/4 of Section 7 and in the West %2 of the Southwest'/4 of Section 8, Township 5
South, Range 81 West of the 6th Principal Meridian in the Town of Avon, Eagle County,
Colorado. The Amended Final Plat will reconfigure la lines for Tracts B and F per the
PUD Amendment first, presented at the December 12, 2006 Council Meeting as Ordinance
06-16. Ordinance 06-16 was subsequently approved at the January 9, 2007 Avon Town
Council Meeting permitting Emergency Services uses within Planning Area N in addition
to park land. This plat signifies the creation of a reconfigured Tract F per the
requirements set forth in Ordinance 06-16,'for conveyance to the Eagle County Health
Services District for construction of an ambulance station. Resolution 07-15, Series of
2007, is included as Exhibit A and a copy of the Amended Final Plat is included as
Exhibit B.
®iscussiona
The previous Plat for the property included Tract F located adjacent to the Interstate 70
right of way and located approximately 350 feet from Swift Gulch Road to be accessed
via,a thirty-foot wide portion of Tract F, designated as an access, drainage, utility, and
landscaping easement, extending to Swift Gulch Road. Pursuant to the PUD Amendment
approved via Ordinance 06-16, Tract F is to be relocated adjacent to Swift Gulch Road, a
new access easement for Tract B will be created across the northwestern portion of Tract
F, and the previously designated access, drainage, utility, and landscaping easement will

be vacated. Approval of the PUD Amendment was contingent on submittal of the •
Amended Final Plat prior to April 1, 2007; the applicant has complied with that approval
condition.
The proposed Amended Final Plat is in conformance with the Annexation and
Development Agreement, The Village (at Avon) P.U.D. Guide and P.U.D. Development
Plan as Amended and has no effect on existing zoning. Approval of the Amended Final
Plat is recommended.
Recommendations:
Approve Resolution No. 07-15, Series of 2007, A Resolution Approving the Amended
Final Plat for The Village (at Avon) Filing 3, a Reconfiguration of Tracts B and F, Town
of Avon, Eagle County, Colorado.
