A RESOLUTION TO DESIGNATE THE NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS)
AS THE BASIS FOR ALL INCIDENT MANAGEMENT IN THE TOWN OF AVON (the "Town").
WHEREAS, on March 1, 2004 the Department of Homeland Security approved the
National Incident Management System as a national standard to provide a unified structure for
local, state and federal emergency preparedness, response, recovery and mitigation activities; and
WHEREAS, use of the National Incident Management System strengthens response
capabilities, promotes common doctrine and principles and integrates best practices for incident
management; and
WHEREAS, the Town recognizes the Federal Government's Homeland Security efforts
and directive to implement a National Incident Management System ("NIMS") to ensure efficient
command and control of major incidents; and
WHEREAS, NIMS is a standardized response management system. It is an "all hazard -
all risk" approach to managing major incident response operations as well as non-major incidents;
and
WHEREAS, NIMS was originally designed by a group of local, state and federal agencies
to improve the ability of fire forces to respond to any type of emergency. It is organizationally
flexible and capable of expanding and contracting to accommodate the responses or incidents of
varying size or complexity; and
WHEREAS, the Incident Command System components of NIMS are already an integral
part of various incident management activities throughout Eagle County, including current
emergency management training programs; and
WHEREAS, the Town of Avon has adopted the Eagle County Inter-Jurisdictional Emergency
Operations Plan which has adopted the National Incident Management System (NIMS) as the basis
for incident management; and
WHEREAS, the Town recognizes that federal laws require the implementation of an incident
Management System when hazardous materials are involved, and
WHEREAS, the NIMS adoption is now a condition for the receipt of federal preparedness
funds, including grants, contracts and other activities such as personnel training.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF AVON THAT:
1. The National Incident Management System is hereby adopted as the
basis for all, incident management in the Town.
2. If any section, paragraph, clause or provision of this resolution shall for any
reason be held to be invalid or unenforceable, the invalidity or unenforceability of such
section, paragraph, clause or provision shall in no manner affect any remaining provisions
of this resolution, the intent being that the same are severable.
3. All resolutions or parts of resolutions inconsistent herewith are hereby repealed to
the extent only of such inconsistency. This repealer shall not be construed to revive any
resolution or part of any resolution heretofore repealed.
4. This resolution shall take effect upon approval by the Town Council.

Re: Resolution designating the National Incident Management System (NIMS) as the
Basis for all incident management in the Town of Avon
Summary: NIMS is a standardized response management system that is intended, to be
used in all hazards and all risks, from major catastrophic regional incidents to more
minor, local problems. The use of this system strengthens response capabilities,
promotes common doctrine and principles and integrates best practices for incident
management.
The purpose of this resolution is to officially adopt the use of NIMS to handle incident
management in the Town of Avon.
Discussion: In 2004, the Department of Homeland Security approved NIMS as a
national standard to provide a unified structure for local, state and federal emergency
preparedness, response, recovery and'mitigation activities. NIMS was originally
designed-by a group of fire agencies seeking to improve the quality of their response to
any type of emergency. It is organizationally flexible and capable of expanding and
contracting to accommodate the responses of incidents of varying sizes and complexity,
Many of the components of NIMS' predecessor, the Incident Command System' (ICS),
are integral to NIMS and have been in use in incident management in the area for at least
15 years. Emergency response agencies in our valley, including personnel from the Avon
Police Department, are being or have been trained in NIMS. The use of NIMS is now a
condition for the receipt of federal preparedness funds, including grants, contracts and
other activities such as personnel training.
It should be noted that the Avon Police Department is active in the Eagle County Public
Safety Council, an alliance of.all emergency responders in Eagle County. This forms the
basis for close cooperation between all of us who provide emergency services. These
groups will be our backbone in the event of a major incident occurring in Avon. NIMS
will allow us to more quickly resolve the incident.
All Town of Avon Police and Public Works managers will be trained in the use of NIMS.
There are also abbreviated, overview'courses available for elected officials and
- administrators.
Recommendation: We recommend adopting the resolution.
