No. 2005-08 DECLARING THE ACQUISITION OFTOWN OF AVON, COLORADO RESOLUTION 05-08 SERIES OF 2005 A RESOLUTION DECLARING THE ACQUISITION OF POTENTIAL FUTURE PHASE, AVON TOWN SQUARE COMMERCIAL CONDOMINIUMS, LOT 2, PHASE II, TO BE IN PURSUANCE OF A PUBLIC PURPOSE AND AUTHORIZING ALL STEPS NECESSARY AND PROPER FOR ACQUISITION OF THE SAME WHEREAS, the Town Council has directed, authorized and budgeted for the acquisition of Potential Future Phase, Avon Town Square Commercial Condominiums, Lot 2, Phase II ("the Parcel"); and WHEREAS, the acquisition thereof and the construction thereon of a regional transportation center and a portion of a multimodal passageway from the Avon Town Center Pedestrian Mall, across the Parcel, to the Confluence parcel, for purposes, arising from the Town Center Implementation Plan and general public interest in.multimodal connectivity (transit, vehicular, pedestrian and public parking) between all properties in the adjacent sub area of the Town, as prescribed in the master plan documents, to the gondola proposed to be located on the Confluence parcel, is in pursuance of the public interest and for a public purpose; WHEREAS, acquisition of the Parcel will require negotiation or the exercise of the power of eminent domain; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COLORADO: Section 1. The Town Council of the Town of Avon declares the acquisition of Potential Future Phase, Avon Town Square Commercial Condominiums, Lot 2, Phase II ("the Parcel") to be in pursuance of the public interest and for a public purpose. Section 2. The staff of the Town are authorized to take all actions necessary and proper for acquisition of the Parcel, including, but not limited to, acquisition of the Parcel by negotiation or the power of eminent domain. Section 3. All action heretofore taken by the staff of the Town of Avon directed toward the forgoing purpose is hereby ratified, approved and confirms ADOPTED at a regular meeting of the the 22nd day of February, 2005.
