RESOLUTION NO. 99 - 28

A RESOLUTION APPROVING THE FINAL PLAT, A RESUBDIVISION OF LOT 27,
BLOCK 1, WILDRIDGE, TOWN OF AVON, EAGLE COUNTY, COLORADO.
WHEREAS, Western Slope Constructors, Inc. has submitted aFinal Plat for a Resubdivision of Lot
27, Block 1, Wildridge, Town of Avon, Eagle County, Colorado; and
WHEREAS, the Final Plat has been reviewed by the Town Staff; and
WI-EREAS, the Final Plat was found to be substantially in conformance with Title. 16 of the Avon
Municipal Code; and
WHEREAS, the proposed subdivision complies with the requirements for consideration as a Final
Plat.
NOW, THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF
AVON, that the Final Plat for A Resubdivision of Lot 27, Block 1, Wildridge, Town of Avon, Eagle
County, Colorado, is hereby approved by the Town of Avon subject to:
1. The execution of a Maintenance Agreement between Western Slope Constructors, Inc..
and the Town of Avon which shall provide: (a) the agreement shall be expressly binding
on all successors in interest-in the property; (b) the owner (s) of the propery are
responsible for maintenance of the drainage pipe thereon, to the satisfaction of the
Town of Avon Public Works Department; (c) should there be a failure of the property
owner (s) to maintain the drainage pipe to the satisfaction of the Town of Avon, then
the Town will cause the proper maintenance to perform, at the expense of the property
owner (s); and (d) a lien in the amount of any repair and maintenance costs incurred by
the Town may be placed on the property by the Town.
2. The completion of technical corrections as identified by Town Staff.

MAINTENANCE AGREEMENT
This agreement by and between the Town of Avon ("the Town") and Western Slope
Constructors, Inc.("property owner"), witnesseth:
Whereas property owner is the owner of Lot 27, Block 1, Wildridge Subdivision,
Town of Avon, Eagle County, Colorado ("the property"); and
Whereas property owner has applied to the Town for approval to subdivide the
property; and
Whereas the Town's approval of property owner's application is conditioned on
property owner's entering into this maintenance agreement; and
Whereas property owner and the Town wish to subject the property to this
maintenance agreement;
Now therefore, the parties agree as follows:
1. This agreement shall be binding on all of property owner's successors in interest in
the property, and, when recorded, shall be a covenant running with the land.
2. Property owner and any successors in interest in the property shall be responsible
for maintenance and repair of the drainage pipe on the property.
3. Should there be a failure of property owner or its successors in interest to maintain
and repair the drainage pipe to the satisfaction of the Town, then the Town may cause proper
repair or, maintenance to be performed, at the expense of property owner or its successors.
4. The amount of any repair or maintenance cost incurred by the Town shall be a lien
on the property.
