No. 1999-18RESOLUTION NO. 99 - 18 SERIES OF 1999 A RESOLUTION OF THE TOWN OF AVON, COLORADO, ACKNOWLEDGING CHAPEL SQUARE ENCROACHMENT WHEREAS Chapel Square, LLC ("Developer") has dedicated to the Town of Avon a public alley known as Chapel Alley pursuant to the Subdivision Improvement Agreement executed on May 10, 1999, and WHEREAS the Town wishes to acknowledge that certain improvements on property owned by Developer encroach into Chapel Alley, and to accept such encroachments. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COLORADO: Section 1. The Town Council hereby authorizes the Mayor to execute the attached Acknowledgement of Encroachment. TOWN OF AVON, COLORADO Ui J Yoder, a3 ATTEST:A Stacy Mays, Deputy Town Clerk ACKNOWLEDGMENT OF ENCROACHMENT Chapel Square, LLC ("Developer") has dedicated to the Town of Avon a public alley known as Chapel Alley pursuant to, the Subdivision Improvement Agreement executed on May 10, 1999. Certain improvements constructed on property owned by Developer encroach into Chapel Alley. The Town of Avon acknowledges and accepts the encroachment of existing improvements into Chapel Alley, consisting of the patio, stairwell, curbing, sidewalks, landscaping, and other exterior portions and features of the building known as Building B adjacent to Chapel Alley (the "Encroachments"), provided such improvements do"not interfere with the free circulation of vehicular traffic through Chapel Alley. The Encroachments shall be shown on the Condominium Map of Building B adjacent to Chapel Alley as approved by, the Town of Avon and on the Amended Plat of the Chapel Square Subdivision recorded with the Eagle County, Colorado Clerk and Recorder's Office.
