A RESOLUTION AUTHORIZING THE TOWN MANAGER
OF THE TOWN OF AVON, COLORADO TO EXECUTE,
FILE AND.ACCEPT APPLICATIONS AND ASSURANCES
REQUIRED FOR FINANCIAL ASSISTANCE FROM THE
UNITED STATES DEPARTMENT OF'TRANSPORTATION
WHEREAS,'it is the best interest.of the Town of Avon,
Colorado to authorize the filing of all applications with the
Department of Transportation, United States of America, for
planning, capital, training, demonstration, research and
development, and/or operating assistance grants under the Federal
Transit Act of 1964, as amended; and
WHEREAS, the Secretary of Transportation is authorized to
make grants-for mass transportation projects; and
WHEREAS, the Town of Avon is a duly created political
municipality of the State of Colorado, having the.authority to
accept grants from the federal government and to enter into
contracts in order to obtain aid, assistance,.and cooperation
under federal legislation; and
WHEREAS, contracts for financial assistance will impose
certain obligations upon the Town of Avon, including the provision
by it of local share of the project costs; and
WHEREAS, it is required by the U.S. Department of
Transportation in accord with the provisions of the Title VI of
the Civil Rights Act-of 1964,_t4at.in connection with the filing
of all applications for financial assistance,. under the Federal
Transit:Act of 1964,. as'amended, the applicant give an assurance
that it will comply with Title VI of the Civil Rights Act of 1964
and.other pertinent directives and the U.S.- Department of
Transportation requirements thereunder; and
WHEREAS, it is the goal of the Town of Avon that minority
business enterprises (disadvantaged business enterprises and women
business enterprises) be utilized to the fullest extent possible
in connection with all projects, and definitive procedures shall,
be established and administered to ensure that minority business
enterprises shall have the maximum feasible opportunity to compete,
for construction contracts, supplies and equipment contracts and
to provide consultant and other services;
NOW, THEREFORE,, BE IT RESOLVED by the Town Council of the
'Town of Avon,.Colorado that:
The Town Manager of the Town of Avon is authorized to
execute and file all applications on behalf of the Town of Avon,
Colorado with the'U.S. Department of Transportation, to aid in the
financing of all planning, capital, training, research and
development, demonstration, and/or operating assistance projects.
The Town of Avon Town Manager is authorized to execute and
file with such applications and assurances or any other document
required by the-U.S. Department of Transportation effectuating
the purposes of the proposed projects.
The Town of Avon Town Manager-is authorized'.to set forth
and execute minority business enterprises (disadvantaged
enterprise business and woimen business enterprise)-policies and'
procedures in connection with procurement needs of all projects.
The Town Manager for the Town of Avon, Colorado is
authorized to accept and execute all grant agreements on behalf,of
the Town of Avon with the-U.S. Department of Transportation to aid
in'the financing of all planning, capital, training, research and
development, demonstration, and/or operating assistance projects.
