No. 1992-41TOWN OF AVON RESOLUTION NO. 92 - 41 SERIES OF 1992 A RESOLUTION APPROVING THE PRELIMINARY PLAT FOR MOUNTAIN STAR SUBDIVISION, A REPLAT AND RESUBDIVISION OF REPLAT NUMBER 1 OF THE FINAL SUBDIVISION PLAT WILDWOOD, TOWN OF AVON, AS RECORDED IN BOOK 337, PAGE 364, IN EAGLE COUNTY, COLORADO WHEREAS, Mountain Star Limited Liability Co. has submitted a Preliminary Plat for Mountain Star Subdivision, a replat and resubdivision of Replat Number 1 of the Final Subdivision Plat Wildwood, Town of Avon, as recorded in Book 337, Page 364, in Eagle County, Colorado; and WHEREAS, the Preliminary Plat was reviewed by Town Staff and the Planning and Zoning Commission and was found to be substantially in accord with regulations of the Town of Avon, and is recommended for aproval subject to certain conditions. NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Avon that this Preliminary Plat of is hereby approved by the Town of Avon subject to completion of the -1- following conditions prior to Final plat approval: 1. The Final Plat shall designate sufficient road right-of-way to allow the roads to be improved to current Town standards related to road widths. 2. The pedestrian path from Woodrush to Goldenrod and Goldenrod to Paintbrush shall be designated, constructed and maintained to allow emergency vehicle access during the non-winter months. 3. All homes and buildings must contain monitored fire alarms and have fully operational fire sprinkler systems. Roof construction shall meet Class B building code requirements. 4. Two public trailhead and parking areas will be designated and constructed by the developer; one in conjunction with the Wildwood Road extension and one in conjunction with Buck Creek Road construction. The trailheads will be constructed in general accordance and with final approval of the Town, with the trailhead design drawings by Dennis Anderson Associates, Inc., dated January 7, 1993 and January 12, 1993. 5. The final water distribution system design must be approved by the Avon Metropolitan District. -2- 6. The Town of Avon has been working on a recreation dedication ordinance. Although the ordinance is incomplete at this time, and has not been adopted, this development shall meet the intent and spirit of the ordinance. Developer shall comply with all provisions of the adopted ordinance. 7. Wildwood and Buck Creek Roads are to be dedicated as public roads on the Final Plat. Buck Creek Road and the portion of Paintbrush located on U. S. Forest lands must be constructed by the developer in conformance with plans approved by the Town of Avon. All other roads within the PUD as shown on the Preliminary Plat are to be private roads. 8. The Preliminary Plat approval is subject to development of a satisfactory Subdivision Improvements Agreement in conjunction with the Final Plat. 9. The typical cross sections contained in pages 87, 88, 89, 90, and 91 of the submittal booklet shall serve as a general guide for development of roads within Mountain Star. -3- INTRODUCED AND APPROVED this 23rd day of February , 1993.
