A RESOLUTION AUTHORIZING
ACQUISITION OF RIGHTS-OF-WAY AND
EASMENTS FOR AN IMPROVEMENT PROJECT
OF THE TOWN OF AVON
WHEREAS, the Town Council of the Town of Avon finds and
determines that the public interest and necessity require the
construction of public improvements along Beaver Creek Boulevard
near its intersections with Avon Road and Beaver Creek Place,
such improvements to consist essentially of improving that
intersection with street widening, turning lanes, paving,
retaining walls, sidewalks, storm drainage, utility relocation,
and landscaping ("the Project"); and
WHEREAS, agreement has not been reached with adjacent
property owners as to compensation for acquisition of the rights-
of-way and easements necessary for completion of the Project;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of
the Town of Avon, as follows:
1. The filing of such petitions in condemnation as are
necessary to the acquisition of the rights-of-way and easements
necessary for the completion of the Project is hereby authorized.
2. All action heretofore taken by the agents and
employees of the town in implementation of this resolution is
hereby ratified and confirmed.
