No. 1988-09• RESOLUTION NO. 88-9 SERIES OF 1988 • A RESOLUTION STATING THE TOWN OF AVON'S OPPOSITION TO THE PROPOSED TWO FORKS AND WILLIAMS FORK WATER PROJECTS AND REQUESTING DEVELOPMENT OF A COMPREHENSIVE STATEWIDE WATER PLAN WHEREAS, the proposed Two Forks and Williams Fork projects in combination with other water development projects will signifi- cantly degrade the aquatic ecosystem of the Colorado River and it's tributaries; and WHEREAS, the degradation of aquatic ecosystems reduces the aesthetic and recreational values of the area; and WHEREAS, the aesthetic and recreational values of the area are major factors in the economy and economic development oppor- tunities within the area and within the State; and WHEREAS, the proposed projects do not include appropriate and practicable mitigation measures to minimize harm to the aquatic ecosystem; and WHEREAS, there are practicable alternatives to the proposed Two Forks and Williams Fork projects which would have significantly less impact on the aquatic ecosystem; and WHEREAS, higher than current use figures and inaccurate population figures exaggerate the need for the projects; and WHEREAS, major water development projects such as the proposed Two Forks and Williams Fork projects should conform with a comprehensive statewide water plan; and WHEREAS, the State of Colorado has not adopted a compre- hensive statewide water plan; and WHEREAS, the Two Forks and Williams Fork projects are not in the public interest for the above reasons. NOW, THEREFORE, BE IT RESOLVED, that the Town of Avon adamantly opposes issuance of permits for the Williams Fork project and the Two Forks or other major reservoir project on the South Platte River because they fail to meet minimum federal requirements under Section 404 of the Clean Water Act; and BE IT FURTHER RESOLVED, that the Town of Avon, Colorado strongly supports the initiation, development and adoption of a comprehensive statewide water plan which addresses environmental and economic issues as well as water needs for all areas of the State. 1988. Available information indicates there are alternatives to these projects which would be significantly less destructive to-the environment. The application does not include adequate mitigation measures to protect the environment and in particular the aquatic ecosystem of the Colorado River and its tributaries. The cumulative effects of these and other water development projects results in significant degredation to these waters with a resultant loss of aesthetic, recreational and economic values in the area. When evaluating these projects, the cost of mitigating these impacts must be added to the cost of the project. When the full cost of an adequate mitigation plan is added to the cost of these projects, many of the other alternatives.may be more environmentally and economically feasible than the proposed projects. It.is our feeling that the Two Forks and Williams Fork projects clearly fail to meet minimum federal requirements under Section 404 of the Clean Water Act and consequently permits for these projects must be denied. The enclosed Resolution, adopted by the Avon Town-Council at it's May 10, 1988 meeting, expresses our concerns and adamant opposition to these-projects. Available information indicates there are alternatives to these projects which would be'significantly less destructive to the environment. In addition, -requested time frames indicate there is adequate-time to thoroughly investigate these alternatives and even implement some, such as-water conservation measures and coordinated operation of.existing facilities. Projects of this magnitude should only be approved when they are found to be in accordance with a comprehensive statewide water plan which addresses not only water issues, but also-includes environment and economic issues. Since Colorado has not adopted such a plan, we urge you to provide the direction necessary to prepare and implement such a plan immediately. Thank-you again for your consideration in this matter.
