A RESOLUTION APPROVING A PRELIMINARY PLAN AND
FINAL SUBDIVISION PLAT FOR CHAMBERTIN TOWNHOUSES,
FILING NO. 3, A REPLAT OF LOT 46/47, BLOCK 1,
BENCHMARK AT BEAVER CREEK, AMENDMENT NO. 4,
TOWN OF AVON, EAGLE COUNTY, COLORADO
WHEREAS, Clinton E. Watkins and Randy P. Marino have
submitted a Preliminary Plan and Final Subdivision Plat for
Chambertin Townhouses, Filing No. 3, A Replat of Lot 46/47,
Block 1, Benchmark at Beaver Creek, Amendment No. 4, Town of
Avon, Eagle County, Colorado; and
WHEREAS, the Preliminary Plan, Final Subdivision Plat
and related documents have been reviewed by Town Staff and Town
Attorney and were found to be substantially in accord with the
Subdivision Regulations of the Town of Avon; and
WHEREAS, a public hearing has been held at which the
applicant and the public were provided the opportunity to present
testimony and evidence regarding the proposed preliminary plan.
NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the
Town of Avon, that the Preliminary Plan and Final Subdivision
Plat for Chambertin Townhouses, Filing No. 3, A Replat of Lot
46/47, Block 1, Benchmark at Beaver Creek, Amendment No. 4,
Town of Avon, Eagle County, Colorado are hereby approved subject
to:
1. The execution of all certificates and documents
relating to the subdivision, in a manner
satisfactory to the Town Attorney, prior to filing
with the Clerk and Recorder of Eagle County;

2. The deletion of the apparent extension of
Chambertin Circle from the area east of Filing
No. 3;
3. Deletion of the reference to "Future Filing
No. 4" from the plat; and
4. Designation of the address for Filing No. 3
as 0420 on the plat.
ADOPTED AND DATED THIS 8th day of March 1988.

A Preliminary Plan and Final Subdivision Plat for Chambertin Townhouses has
been submitted for review and approval.
The plat has been reviewed by Town Staff and was found to be in general
conformance with Town of Avon Subdivision Regulations. The requested
action includes both Preliminary Plan and Final Plat approval. The
required Public Hearing Notices have been mailed and posted for the Preliminary
Plan Review. RESOLUTION 88-6 would approve the Preliminary Plan and Final
Subdivision Plat for Chambertin Townhouses, Filing No, 3, subject to:
The execution of all certificates and documents relating to the
subdivision in a manner satisfactory to the Town Attorney, prior to
filing with the Clerk and Recorder of Eagle County.
RECOMMENDED ACTION:
1. Public Hearing for Preliminary Plan
2. Adopt Resolution 88-6

Dear Norm:
Having received the Notice of Public Hearing regarding
the Chambertin Townhouse plat, we have the following
concerns as adjacent property owners.
We realize that some of these concerns may appear
insignificant. However, we want to be very careful that
no misleading information becomes a part of a recorded
plat that may indeed improperly effect our real property.
Our concerns are as follows:
1) A twenty five foot wide private drive which is labeled
Chambertin Circle (private) is actually shown across our
property. We object to this being shown as there is no
easement or agreement in place to allow any such use by
our neighbors. The previously recorded plats for the other
two existing Chambertin Townhouse buildings have not shown
such a designation and we do not believe there is any reason
to have such a plat recorded for this building.
2) On the plat which we reviewed, our property is labeled
'Future Filing No. 41. Prior to our purchase of this property,
it was partitioned off from the adjacent project by the courts
and now exists unto itself. There is no future relationship
contemplated with the-Chambertin Townhouses and we therefore
object to our property,being labeled as such on a recorded
plat. It is not necessary for clarity and we believe it could
be misconstrued.
3) The address shown for the plat being recorded is 0410
Nottingham Road. We believe that this is actually our address.
Please consider making this adjustment on the plat so as to
avoid any future confusion.
