WHEREFORE, the Town Council of the Town of Avon is
satisfied ahd'convihced that the approval of-the-Homestake
II Water Diversion Project will cause irreparable injury to
the Town of Avon and Eagle County as a whole, and
WHEREAS, the Town Council of the Town of Avon is
aware that extensive evidence has been presented to the
Board of County Commissioners of Eagle County which
conclusively establishes grounds to deny the permit
requested for the Homestake II Water Diversion Project, and
WHEREAS, the Town Council is also aware that,the
authority of the Board of County Commissioners to deny the
requested permits for the Homestake II Water- Diversion
Project has been questioned based upon legal, rather than
factual, issues,'
NOW, THEREFORE, BE IT RESOLVED by the Town Council
of the Town of Avon that the Board of County Commissioners
be informed that it is the position of this Town Council
that the permits requested of Eagle County for the Homestake
II Water Diversion Project should be denied for the
following reasons, among others:
a) That the Homestake II Water Diversion
Project will eliminate jobs and cause irreparable injury to
the economy of Eagle County, and more specifically to the
Town of Avon;
b) That the activities in association with
the Homestake II Water Diversion Project will cause
irreparable harm to the environment, effecting the quality
of life as well as the economy of Eagle County for the
indefinite future;
c) That the Homestake II Water Diversion
Project will increase pollution levels in the Eagle River,
by the removal of essential diluting flows, above levels
already in violation of applicable standards;
d) That there exist alternatives to the
Homestake II Water Diversion Project which are available to
the applicant cities and would have no impact whatsoever
upon the areas of the State beyond the immediate vicinities
of the cities.
BE IT FURTHER RESOLVED, recognizing the
possibility that the authority of the Board of County
Commissioners of Eagle County to deny the requested permits
may be challenged, that it be recommended to the Board of
County Commissioners of Eagle County that the necessary
denial of the requested permit applications be qualified by
the provision that, in the event such denial is determined
to be unenforceable or otherwise beyond the authority of the
Board of County Commissioners, that there be imposed upon
any permit required to be issued all conditions required by
governmental agencies, all conditions agreed to by the
Cities and acceptable to Eagle County, and all other con-
ditions deemed necessary or desireable, to protect, to the
extent protection can be achieved, the environment, the
economy, the health, safety and welfare of the inhabitants
of Eagle County.
