No. 1987-13• RESOLUTION NO. 87-13 SERIES OF 1987 L A RESOLUTION GRANTING A SPECIAL REVIEW USE TO ALLOW AUTOMOTIVE REPAIR (BODY SHOP), ON LOT 36, BLOCK 1, BENCHMARK AT BEAVER CREEK WHEREAS, Thomas A. Backhus has requested a Special Review Use to allow Automotive Repair (Body Shop) on Lot 36, Block 1, Benchmark at Beaver Creek, which is located in IC (Industrial Commerical) Zone District; and WHEREAS, automotive or other vehicular sales and repair shops are allowed in the IC Zone District as a Special Review Use; and WHEREAS, the Planning and Zoning Commission has held a public hearing and has determined that the proposed use: 1. Otherwise complies with all requirements imposed by the Zoning Code; and 2. Is consistent with the objectives and purposes of the Zoning Code; and 3. Is deemed compatible with surrounding land uses and uses in the area; and WHEREAS, the Planning and Zoning Commission of the Town has approved the Special Review Use to allow Automotive Repair (Body Shop) on Lot 36, Block 1, Benchmark at Beaver Creek, subject to: 1. No wrecked or damaged vehicles will be parked on-site unless they are confined to the designated storage yard for the project. NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Avon, Colorado, concurs with the findings and determinations made by the Planning and Zoning Commission, and hereby approves the Special Review Use to allow Automotive Repair (Body Shop) on Lot 36, Block 1, Benchmark at Beaver Creek, subject to: • 0 1. The following action was taken with regard to the above mentioned item: The Commission made a site visit to Lot 36, Block 1, Benchmark at Beaver Creek. After the site visit and presentation of your application, the Commission adopted Resolution 87-10,-approving a Special Review Use for an auto body repair shop and storage lot. The Commission found the application to comply with Section 17.20.020, Granting of a Special Review Use, and Section 17.20.040, Special Review Use Criteria. This Special Review Use request will be forwarded to Town Council for action and consideration at their meeting on May 26, 1987. Enclosed please find the site plan approved for the design review of the auto body shop approved at the May 5, 1987, regular meeting (Rich's Auto Body). James, Town Manager FROM: Ray Wright, Engineering Technician DATE: May 21, 1987 SUBJECT: Resolution No. 87-13, Series of 1987, Special Review Use Automotive Repair(Body Shop), Lot 36, Block 1, Benchmark at Beaver Creek Thomas A. Backhus has applied for Special Review Use approval to allow an Automobile Repair(body shop)to be located on Lot 36, Block 1, Benchmark at Beaver Creek. Lot 36 is currently undeveloped. Plans for the project have received Design Review approval from the Planning and Zoning Commission. Those plans show a building of approximately 1584 square feet to house the body shop toward the front of the 'lot with a partially fenced storage lot behind. Required parking for the project is being provided between the building and Metcalf Road. Screening for the use will be accomplished by using existing developments on each side of the site, the body shop building, landscaping, and fencing. The Planning and Zoning Commission has held a public hearing on this Special Review Use application. Following a site visit, and review of the project, the Commission approved the Special Review Use and recommended Town Council approval. If the Town Council concurs with the Planning and Zoning Commission action and recommendations, appropriate action would be adoption of Resolution No. 87-13. RECOMMENDED ACTION: Adopt Resolution No. 87-13. i i STAFF REPORT TO PLANNING & ZONING COMMISSION - 5/19/87 Lot 36, Block 1, Benchmark at Beaver Creek Special Review Use to Allow an Auto Body Repair Shop and Storage Lot - Continued from 5/5/87 Regular Meeting INTRODUCTION: At the Planning and Zoning Commission meeting of May 5, 1987, the Commission tabled this application. The Commission adopted Resolution 87-10, approving the'Special Review Use request for an auto body repair shop and storage lot on Lot 36, Block 1, Benchmark at Beaver Creek. The motion was approved by two aye votes and one abstention. A Special Review Use requires a minimum approval vote by a majority of the total authorized membership of the Commission. Due to the inability to meet this requirement, this vote was determined to be a non-action and .a motion was made to table the Special Review Use request. At that meting, the Commission did approve the design review of Rich's Auto Body Shop to be located on Lot 36, Block 1. Conditions include the screening fence be relocated to run east-west along the perimeter of the storage lot rather than north-south across the site; that the stucco, wood siding, and flue colors be indicated on the plans; and a minimum 18" culvert be shown under the driveway. These items are to be shown on the plans prior to issuance of a building permit. STAFF COMMENTS: The Commission should refer to the attached Staff Report from the May 5, 1987, meeting for the Special Review Use Approval Criteria and Findings Required Resolution 87-10 has been modified with the condition that no wrecked vehicles will be parked on the site except in the designated storage yard. RECOMMENDED ACTIONS: 1. Introduce project; 2. Presentation by applicant; 3. Commission review-of submitted materials; 4. Adopt Resolution 87-10. 'The applicant was directed to submit a specific plan for review. The applicant has submitted a set of plans for the project. They include a site plan, building plans, landscape plan, and a site grading and drainage plan. The project generally consists of 1,584 square feet, single story structure, with a flat roof. A stucco exterior is proposed with a wood accent band around the top. There is a paved parking lot for 5 cars in front of the building, and a partially fenced, gravel storage lot for 14 cars behind the building. STAFF COMMENTS: The parking being proposed in front of the building satisfies the minimum parking requirement for a project of this size. The Commission should consider if the landscaping and fencing shown on the plan provides adequate screening for.the storage lot. In accordance with-Section 17.20.020 of the Avon Municipal Code, the Commission shall determine the following in considering the suitability of a special review use: 1. Whether the proposed use otherwise complies with all requirements imposed by the zoning code; 2. Whether the proposed use is consistent with the objectives and purposes of the zoning code and the applicable zoning district; and 3. Whether the proposed use is designed to be compatible with surrounding land uses and uses in the area. In addition, the Commission shall consider: A. The adequacy of access to the site with respect to the width of adjacent streets,-their grades, intersection safety, visibility and entrance into the lot to be developed; B. Whether there exists safe access and sufficient water pressure to provide fire protection; C. Whether there will be provided sufficient off-street parking ds determined by (1) the intended use of the property; (2) walking distance' to the downtown area; and (3) the availability of public transportation; E. The impact of the development considering the potential for stream and air pollution, the availability of public transportation and other public or private services, and any other factors affecting the overall development and the surrounding areas, including but not limited to building height, view plane, drainage and other physical and aesthetical features. RECOWlENDED ACTIONS: 1. Introduce project; 2. Presentation by applicant; 3. Commission review of submitted material; 4. Conduct public hearing; 5. Adopt Resolution 87-10.
