No. 1987-04RESOLUTION NO. 87-4 SERIES OF 1987 a A RESOLUTION APPROVING AS-BUILT PLANS FOR THE WYNFIELD INN AT AVON, ON LOT 73/74, BLOCK 2, BENCHMARK AT BEAVER CREEK, TOWN OF AVON, EAGLE COUNTY, COLORADO AND VERIFYING THE NUMBER OF FRACTIONALIZED RESIDENTIAL DEVELOPMENT RIGHTS UTILIZED BY THE WYNFIELD INN WHEREAS, As-Built Plans for the Wynfield Inn at Avon, located on Lot 73/74, Block 2, Benchmark at Beaver Creek, Town of Avon, Eagle County, Colorado have been submitted in accordance with the Administrative Procedure for Fractionalized Projects as adopted by the Town of Avon; and WHEREAS, Lot 73/74, Block 2, Benchmark at Beaver Creek is currently assigned 71 Residential Development Rights; and WHEREAS, the As-Built Plans for the Wynfield Inn at Avon show: 144 Units 0 - 450 sq.ft. @ 1/4 RDR = 36 RDR's 4 Units 601 - 800 sq.ft. @ 1/2 RDR = 2 RDR's 1 Unit over 1200 sq.ft. @ 1 RDR = I RDR Total Residential Development Rights Utilized 39 NOW, THEREFORE, BE IT RESOLVED, that the As-Built Plans for the Wynfield Inn at Avon on Lot 73/74, Block 2, Benchmark at Beaver Creek, Town of Avon, Eagle County, Colorado are hereby approved by the Town Council of the Town of Avon, Colorado to verify the use of 39 Fractionalized Residential Development Rights in the development of 149 residential and accommodation units in the Wynfield Inn at Avon on Lot 73/74, Block 2, Benchmark at Beaver Creek, Town of Avon, Eagle County, Colorado. ADOPTED AND PASSED, THIS 10TH DAY OF February TOWN OF AVON, COLORADO 1987. T Allan R. o tang am ayor • AD141NISTRATIVE PROCEDURE FOR FRACTIONALIZED PROJECTS I. -Application 0 A. Application for fractionalization of Residential Development Righi.s shall be made concurrent with application for Design Review. B. Application for fractionalization shall include the following materials, in addition to those required for Design Review, as outlined in Planning and Zoning Commission Procedures, Rules and Regulations: 1. Summary listing proposed units, and including: a. Unit size (area in square feet); b. Fraction of Development Right used for each unit; c. Total Development Rights used. 2. Total Development Rights available on-site; 3. Floor plans for each building level, including: a. All exterior building dimensions; b. Interior dimensions of all exterior walls of each unit; c. Identification of all interior common areas and dimensions; d. Angle"of all corners, if other than 90 degrees; e. Identical units may be dimensioned on typical drawing. II. Preliminary Approval A. Planning and Zoning Commission shall act on fractionalization applications in conjunction with final Design Review. Final design approval shall include approval of fractionalization of Residential Development Rights as per approved plans. B. Approval of fractionalization of Residential Development Rights shall lapse and shall bec_irne void two years following the date of final approval of the project unless, prior to the expiration of two years, a building permit is issued and construction is commenced and diligently pursued toward completion. • 0 III. As-Built Drawing or Final Condominium Plat A. Upon substantial completion of a project and prior to issuance of a Certificate of Occupancy, temporary or permanent, as-built drawing of the project shall be submitted for review and approval. S. As-built drawing shall contain the following, as a minimum: 1. Fully dimensioned site plan showing building location - on site and exterior building dimensions; 2. Floor plans for each building level including: a. All exterior building dimensions; b. Interior dimensions of all exterior walls of each unit; c. Identification of all interior common areas and, dimensions; d. Angle of all corners, if other than 90 degrees. 3. As-built-plans shall in certificate of accuracy, signed and sealed by a land surveyor registered in the State of Colorado. C. As-built plans shall be submitted as least 21 days prior to Council meeting at which approval is requested. D. Final As-Built Condominium Plat filed in accordance with Subdivision Regulations will be acceptable in lieu of the above for condominiumized projects. IV. Final Approval A. Fractionalization will be complete upon approval of Final As-Built Plans or Final As-Built Condominium Plat by Town Council. NW/mml 8/85 E M E M 0 TO: Bill James, Town Manager 11 FROM: Norm Wood, Director of Engineering and Community Development DATE: February 3, 1987 RE: Wynfield Inn at Avon Fractionalization of Residential Development Right Approval The Administrative Procedure for Fractionalized Projects, as approved by the Town Council, requires Town Council approval of As-Built Plans to complete the Fractionalization process. In the past, this approval has been in the form of a condominium plat approval. The Wynfield Inn is not a condominium project and consequently a condominium map has not been submitted for approval. The As-Built Plans which have been submitted for approval generally consist of a copy of the plans which were submitted for the building permit with the changes which occurred during construction noted on the drawings. We feel these plans meet the intent outlined in the Administrative Procedure for Fractionalized Projects and recommend Town Council approval to officially document the number of development rights used by the project. RECOMMENDED ACTION: Adopt Resolution 87-4. NW/mml
