No. 1984-45RESOLUTION NO. 84-45 SERIES OF 1984 P_ RESOLUTION GRANTING A SPECIAL REVIEW USE FOR TIME SHARING AS AN ALLOWABLE USE ON LOTS 73/74, BLOCK 2, BENCHMARK AT BEAVER CREEK WHEREAS, Savoy Square, Inc. has requested a Special Review Use for time sharing as an allowable use on Lots 73/74, Block 2, Benchmark at Beaver Creek Subdivision; and WHEREAS, the Planning and Zoning Commission has held a public hearing and has determined that the proposed use: 1. otherwise complies with all requirements imposed by the Zoning Code; and 2. is consistent with the objectives and purposes of the Zoning Districts; and 3. is deemed compatible with the surrounding land use and uses in the area; Subject to: 1. applicant obtaining all other necessary Town of Avon approvals; 2. approval will expire 2 years after Avon Town Council approval, unless a building permit is obtained within this 2 year period; NOW THEREFORE BE IT RESOLVED THAT the Town Council hereby approves the Special Review Use request for time sharing as an allowable use on Lots 73/74, Block 2, Benchmark at Beaver Creek Subdivision, subject to: 1. applicant obtaining all other necessary Town of Avon approvals; 2. approval will expire 2 years after Avon Town Council approval, unless a building permit is obtained within this 2 year period; DATED: APPROVED: t Allan R. DATE: October 31, 1984 RE: Special Review Use - Time Share Savoy Square Lots 73/74, Block 2, Benchmark at Beaver Creek At the October 25, 1984 Planning and Zoning Commission meeting, the Commission approved a Special Review Use for time sharing on Lots 73/74, Block 2, Bench- mark at Beaver Creek. Approval was given with the following conditions: 1. Subject to obtaining all other necessary Town of Avon approvals; 2. Approval will expire 2 years after Avon Town Council approval, unless a building permit is obtained within this 2 year period. A Special Review Use requires final action by the Town Council. The final action may be granting, denying or granting with conditions identical to, or different from those prescribed by the Planning and Zoning Commission. In approving a Special Review Use, the Town Council may prescribe appropriate conditions and safeguards in conformity with zoning laws of the Town. Resolution #84-45 provides for approval of the Special Review Use with the conditions as prescribed by the Planning and Zoning Commission.
