A RESOLUTION GRANTING A SPECIAL REVIEW USE
FOR PLACEMENT OF A MICROWAVE ANTENNA
ON LOT 35, BLOCK 1, BENCHMARK AT BEAVER CREEK SUBDIVISION
WHEREAS, Heritage Cablevision has requested a Special
Review Use for the placement of a microwave antenna on Lot 35,
Block 1, Benchmark at Beaver Creek Subdivision;
and
WHEREAS, the Planning and Zoning Commission has determined
that the placement:
(1) complies with all requirements imposed by the Zoning
Code,
(2) is consistent with the objectives and purposes of
this Zoning Code and the applicable zoning district,
(3) will be compatible with surrounding land uses and
uses in the area,
subject to,
(1) such approval will not give Heritage Cablevision
any rights to restrict development or building in
that area which may interfere with the microwave
signals,
NOW THEREFORE BE IT RESOLVED that the Town Council hereby
approves the Special Review Use for the placement of a microwave
antenna on Lot 35, Block 1, Benchmark at Beaver Creek Subdivision,
subject to the following:
(1) such approval will not give Heritage Cablevision
any rights to restrict development or building in
that area which may interfere with the microwave
signals.

Lot 35, Block 1, Benchmark at Beaver Creek Subdivision
Heritage Cablevision
At the June 28, 1984 meeting of the Planning and Zoning Commission, a request
from Heritage Cablevision for a variance to encroach into the side'lot set-
back of Lot 35, Block 1, Benchmark at Beaver Creek was considered. The
variance request was to allow installation of a microwave antenna on the site
as approved by Special Review Use. After making-the required findings, the
Planning and Zoning Commission approved the variance request with the condition
that two 4 x 4 wooden posts would be placed on each side of the microwave dish
to prevent people from walking under the equipment.
Council action on a variance request is required only if an appeal is filed
with the Town Council by the applicant, the Town Attorney or any interested
party. No appeals have been filed to date.

Lot 35, Block 1, Benchmark at Beaver Creek Subdivision
At the June 28, 1984 Planning and Zoning Commission meeting, the Commission
,approved a Special Review Use for placement of a microwave antenna for
Heritage Cablevision on Lot 35, Block 1, Benchmark at Beaver Creek Subdivision.
Approval was given with the condition that Heritage Cablevision will not
have any right to restrict development or building in that area which may
interfere with the microwave signals.
A Special Review Use requires final action by the Town Council. The final
action may be granting, denying or granting with conditions identical to, or
different from those prescribed by the Planning and Zoning Commission.
In approving a Special Review Use, the Town Council may prescribe appropriate
conditions and safeguards in conformity with the zoninq laws of the Town. ,
Resolution Number 84-19 provides for approval of the Special Review Use
with the condition as prescribed by the Planning and Zoning Commission.
