A RESOLUTION ESTABLISHING A CONSERVATION TRUST FUND
WHEREAS, Article 21 of Title 29, C.R.S. 1973, as amended in
1982 by S.B. 119, provides for the Conservation Trust
Fund for municipalities and counties and certain special
districts, and further provides for lottery proceeds to
be deposited to said fund, and which act authorizes the
creation of such a fund by Town of Avon, Colorado; and,
WHEREAS, The Governing Body of Town of Avon, Colorado desires
to create such a fund for the Health, Safety and
Welfare of present and future citizens of this munici-
pality; and,
NOW THEREFORE BE IT RESOLVED by the Governing Body of Town of
Avon, Colorado that a Conservation Trust Fund be and
the same hereby is created pursuant to Article 21 of
Title 29, C.R.S. 1973, for Town of Avon, Colorado and
that monies received from the State of Colorado pur-
suant to said statues be deposited in said fund and
expended only for the purposes set forth in said law;
and,
BE IT FURTHER RESOLVED that a copy of this Resolution be
certified to the Colorado Division of Local Government
in the Department of Local Affairs.

Dear Local Government Official:
,Senate Bill 119 of 1982 earmarks 40% of the lottery's net proceeds
to park, recreation and open space programs in counties, municipalities
and certain special districts through the state Conservation Trust
Fund (29-21-101, C.R.S. 1973). The Division of Local Government
will be responsible for the distribution of lottery monies to local
government entities in September, 1983 under the provisions of SB 119.
In order to become eligible for receipt of these funds, you must
establish a local Conservation Trust Fund and so certify this action
to the Division of Local Government.
For counties and municipalities which have previously done this, the
completion and return of the recertification form (enclosed) is
all that is required, on or before December 31, 1982.
If your entity has not established a Conservation Trust Fund and
wishes to do so, please complete and return your resolution and
affidavit to the Division on or before December 31, 1982.
All Metropolitan Districts are required to furnish their District Court
Decrees,Service Plan, including any approved changes to their Service
Plan pertinent to park or,recreation services.
The Division must receive this material by December 31, 1982 in order
for your local government entity to receive lottery revenue in September,
1983.
For the first time, certain special districts will share in the distri-
bution of lottery proceeds. Since the money will be returned to local
governments on a per capita basis, accurate population information for
counties, municipalities, and certain special districts is important.
Further, this population data must be related to the legal boundaries
of the local governments,eligible to receive funds. This can only be
accomplished with accurately drawn, up-to-date standardized maps.
The use of the enclosed map preparation guidelines will facilitate the
development of the required boundary maps.
