W4EREAS, the Town of Avon has executed a gubdivision Improvements
Agreement dated July 10, 1979, with Wildridge Development Company which
nareement Drovides for the Town of Avon to hold certain unsold Darcels of land
as collateral pending the completion of the installation of certain utilities
and roads; and
WHEREAS, Wildridge Development Company has previously given to the Town of
Avon a deed of trust on all of Block 5, in the Wildridge Subdivision; and
WHEREAS, the Town of Avon has approved a replat of the Wildridge
Subdivision; and
WHEREAS, said replat decreases the number of lots in Block 5, from
twenty-six (26) lots to eleven (11) lots and increases the total number of
units from fifty-two (52) units to seventy-five (75) units; and
WHEREAS, Wildridge Development Company has requested the Town of Avon to
release that certain deed of trust dated the 13th day of May, 1980, encumbering
Block 5, Lots I through 26, Wildridge Subdivision; and
WHEREAS, Wildridge Development Company shall execute a new deed of trust
encumbering Block 5, Lots 1 through 11, Wildridge Subdivision, as per Replat
0-2, for the use and benefit of the Town of Avon; and
WHEREAS, the Town Council of the Town of Avon being satisfied that the

value of the remaining collateral in Block 5, Wildridge Subdivision, per Replat,
#2, is sufficient to saitisfy the purposes for which said collateral is being
held.
NOW, THEREFORE, be it hereby resolved by the Town Council of the Town of
Avon, Colorado:

THAT, the Subdivision Improvenents Agreement referred to hereinabove shall
he amended to reflect that the collateral for said Agreement shall be all of
Block S, Wildridge Subdivision, as per Replat #2, or such other collateral as
the Town of Avon and Wildridge Development Company may nutually agree upon from
time to time.
RE IT FURTHER RESOLVED, that that certain deed of trust dated the 13th day
EXECUTED this day of September, 1981.
of May, 1980, recorded in Book 303 at Page 463, County of Eagle, State of
Colorado, be released by the Town of Avon upon recording of the approved plat
of Replat #2 Wildridge Subdivision and upon receipt of a new deed of trust to
be recorded describing said Block S, per Replat #2, as approved by the Town
Council of the Town of Avon at its regular tweeting held August 11, 1981.
