RESOLUTION NO. 19
SERIES OF 1979
A RESOLUTION AUTHORIZING THE REMOVAL OF CERTAIN MATERIAL
FROM THE TOWN OFFICES BY DEPARTMENT HEADS AND THEIR
DESIGNEES AND PROVIDING FOR CERTAIN DETAILS IN RELATION
THERETO.
WHEREAS, the propriety of the removal of certain
town material from the Avon town offices has been brought
to the attention of the Town Council; and
WHEREAS, the work load, working conditions and
dedication of the employees of the Town of Avon has also
been brought to the attention of the Town Council; and
WHEREAS, the obligation of the Town of Avon to
provide certain information and certain documents for
copying or inspection to the citizens of the Town of Avon
is also known by the Town Council,
NOW, THEREFORE, be it hereby resolved by the
Town Council of the Town of Avon, Colorado, that:
All department heads including the Town Clerk
and the Town Attorney and any additional persons
that such department heads may designate, either on
a continuing or specific event basis, are hereby
authorized to remove from the town offices at such
times as their work schedule or other obligations
and needs may dictate, any materials, including, but
not limited to files, applications, plans, drawings,
correspondence and other documents; provided, that
upon the removal of such material, some indicator
that material has been removed shall be left in
its place. Additionally, every reasonable effort
shall be made to keep the material so removed in as
good condition as it would have been if it had

remained in the office. If requests are received
from the public for access to material which has
been so temporarily removed, a written memo shall
be prepared by the person receiving the request and
forwarded without delay to the department head or
other person under whose custody the requested
material is kept. Such department head shall follow
up on the request for access and shall make any
material kept under his custody available for inspec-
tion or copying within a reasonable amount of time.
Any material normally kept in the town offices which
is removed by a town employee shall be returned with-
out unreasonable delay when the purpose for its removal
has ended.
If any part, section, subsection, sentence,
clause, or phrase of this Resolution is for any
reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this
Resolution, and the Town Council hereby declares
it would have passed this Resolution, and each part,
section, subsection, sentence, clause or phrase
thereof regardless of the fact that any one or more
parts, sections, subsections, sentences, clauses
or phrases be declared invalid.
