No. 1999-15 Repealing and reenacting Chapter 15.32 of the Avon Muni CodeTOWN OF AVON ORDINANCE NO. 99 -15 SERIES OF 1999, AN ORDINANCE REPEALING AND REENACTING CHAPTER 15.32 OF THE AVON MUNICIPAL CODE: ADOPTING BY REFERENCE THE 1997 EDITION OF THE UNIFORM FIRE CODE, VOLUMES 1 AND 2 AND SETTING FORTH IN REGARD THERETO WHEREAS, the 1997 Edition of the Uniform Fire Code, Volumes 1 and 2 have been published; and WHEREAS, the Town of Avon wishes to adopt the 1997 Edition of the Uniform Fire Code, Volumes 1 and 2: NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COUNTY OF EAGLE, STATE OF COLORADO, THAT: Chapter 15.32 of the Avon Municipal Code is hereby repealed and reenacted to read as follows: SECTION: 15.32.010 . Section 1007.2.3 — Fire Alarm Systems, Group B Occupancies 15.32.180 Section 1007.2.8 — Fire Alarm Systems, Group M Occupancies 15.32.190 Section 1007.2.9.1.1 — Fire Alarm Systems, New Group R Occupancies, General 15.32.200 Section 1007.3.1 — General System Design and Installation Requirements, Design Standards 15.32.210 Section 1007.3.3.6.1 — General System Design and Installation Requirements, Monitoring 15.32.220 Section 1102.1 - Incinerators, Open Burning and Commercial Barbecue Pits, General 15.32.230 Section 1106 - Gas Meters and Piping 15.32.240 Section 1109.7 — Control "of Sources of Ignition, Sparks from Chimneys 15:32.250 Violation 15.32.260 Penalty 15.32:270 Validity 2 CHAPTER 15.32 15.32:010 Adoption Pursuant to Section 6.9 of the Charter of the Town, there is hereby adopted, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire, hazardous materials or explosion, that certain standards known as the Uniform Fire Code, including appendix chapters: I -C Stairway Identification, II -E Hazardous Materials Management Plans and Hazardous Materials Inventory Statements, II -F Protected Aboveground Tanks for Motor Vehicle Fuel- , Dispensing Stations Outside Buildings, II -I Ozone Gas - generating Equipment, III -A Fire -flow Requirements for Buildings, III -B Fire Hydrant Locations and Distribution, III -C Inspection, Testing and Maintenance of Water -based Fire- protection- Systems, V -A Hazardous Materials Classifications, VI -E Reference Table from the Uniform Building Code, VI -I Unit conversion Tables, and the Uniform Fire Code Standards published by the International -Fire Code Institute, 5360 Workman Mill Road; Whittier, California, 90601 -2298, being particularly the 1997 Editions thereof, save and except such portions as are hereinafter deleted, modified or amended by this ordinance, of which three copies have been and are now filed in the office of the Avon Town Clerk and are available for inspection during normal business hours, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date of which the ordinance codified in this chapter shall take effect. 'The repeal or the repeal and re- enactment of any portion of the code of the Town of Avon, Colorado as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any action or proceeding as commenced under or by virtue of the provision repealed or repealed . and re- enacted. The repeal of any provision here shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 15.32:020 Additions or Modifications. The Uniform Fire Code is amended and changed in Sections 15.32.010 through 15.32.270. 15.32.030 Section 104.1.2 - Authority- at Fires and Other Emergencies, Interference Section 104.1.2 is amended to include the following: It shall be unlawful for any person to interrupt, silence, or disconnect any signal or fire alarm system signal which indicates the presence of an emergency fire condition. Fire alarm panel troubles signals, maintenance signals, testing signals or as approved in writing 'by the Chief shall not be construed as an emergency fire condition." 15.32.040_ Section 105.8 —Permits, Permits Required All permits required under this subsection are expressly deleted, save and except the following sections in their entirety. c. 11. Candles and open flame in assembly areas. c.2. Carnivals and fairs c.7. Compressed gases c.9. Cryogens e.I. Explosives or blasting agents f.2. Fireworks f.3. Flammable or combustible liquids h:l . Hazardous Materials I.1. Liquefied petroleum gases o. 1. Open burning p.3. Pyrotechnical special effects material 15.32.050 Section 207 - Definitions and Abbreviation, F False Alarm.is amended to read: False alarm is the reporting of an alarm for which no such fire or emergency exists. 4 15.32.060 Section 1001.5.2 — Fire Ptotection Systems and Equipment, Inspection and Testing Section 1001.5.2 is amended to read beginning at paragraph 2: Automatic fire - extinguishing systems shall be inspected and tested at least annually. See Appendix III -C for recommended guidelines. Fire alarm systems shall be inspected and tested at least annually. See UFC Standard 10 -2 for recommended guidelines. Standpipes shall be inspected and tested. at least every five years. See NFPA 14 for recommended guidelines. Exceptions: 1) Automatic fire- extinguishing equipment associated with commercial cooking operations when in compliance with Section 1006. 2) Systems in high -rise buildings when in compliance with Section 1001.5.4. Reports of inspections and tests shall be maintained with the building owner or representative and forwarded to the Chief. 15.32.070 Section 1003.1- Sprinkler System Monitoring and Alarms, Where Required Section 1003:1 is amended to read: All valves controlling the water supply for automatic sprinkler systems shall be electrically monitored. Monitored signals shall be transmitted to the fire department by an approved method. 15.32.080 Section 1003.2 — Fire Extinguishing Systems, Required Installations Section 1003.2 is amended to add Section 1003.2. 10 Group S, Division 1 and 2 Occupancies. An automatic sprinkler system shall be installed in all Group S, Division 1 and 2 Occupancies where the floor area exceeds 6,000 square feet on any one floor or 12,000 square feet on all floors. 1532.090 Section 1003.2.4 = Group E Occupancies, General Requirements Section 1003.2.4 is amended to delete exception 2. 15.32.100 Section 1003.2.8 —Fire. Extinguishing Systems, Group M Occupancies Section 1003.2.8 is amended to read: An automatic sprinkler system shall be installed in rooms classed as Group M Occupancies where the floor area exceeds 6,000 square feet on any floor or 12,000 square feet on all floors or in Group M Occupancies more than three stories in height. The areas of mezzanines shall be included in determining the areas where sprinklers are required. 15.32:110 Section 1003.2.9 — Fire Extinguishing Systems, Group R, Division 1 Occupancies Section 1003.2.9 is amended to read: An automatic sprinkler system shall be installed throughout every apartment or condominium three or more stories in height or containing 12 or more dwelling units, every congregate residence three or more stories-'in height or having an occupant load of 20 or more, and every hotel three or more stories in height or containing 20 or more guest rooms. Residential or quick - response standard sprinklers shall be used in dwelling units and guestroom portions of the building. 15.32.120 Section 1004.1.1= Standpipes, General Requirements Section 1004. 1.1 is amended to read beginning the third paragraph: The location of fire department hose connections shall be approved by the Chief. In buildings used for high -piles combustible storage, fire protection shall be in accordance with Article 81. In any occupancy other than R3, where fire department vehicular access to within 20' of 50% of the exterior perimeter, including access to at least one side of the highest portion of the building is not provided, the Chief may require Class 1 standpipes. Standpipes are recommended to be dry to minimize failure of systems due to freeze. Hose requirements may be deleted or replaced with fire extinguishers as required by the Chief. 15.32.130 Table 1004 -A Standpipe, Required Systems Table 1004 -A footnotes are amended to read, beginning with footnote 4: 4. In open structures where Class II standpipes may de damaged by freezing, the Fire Chief may:authorized the use of Class I standpipes which are located as required for Class II standpipes 5. For the purposes of this table, occupied roofs of parking structures shall be considered an additional story. In parking structures, a tier is a story. 6. Class II standpipes need not be provided in assembly areas solely for worship. 15.32.140 Section 1006.1— Protection of Commercial Cookine Operations Section 1006.1 is amended to include: Activation of the fire extinguishing equipment shall send a monitored signal notifying the fire department in an approved method. 15.32.150 Section 1007.2.1.2 — Fire Alarni Systems, Use of Area Separation Walls to Define Separate Buildings Section 1007.2.1..2 is amended to include: For the purposes of Section 1007, area separation walls shall not define separate buildings and shall include all habitable levels. 15.32.160 _ Section 1007.2.2.1— Fire Alarm Systems, Group A Occupancies Section 1007.2.2.1 is amended to read: Group A, Divisions 1,2,2.1 and 3 Occupancy shall be provided with manual and automatic fire alarm systems in accordance with Section 1007.2.2. Exceptions: 1) Group A Occupancy portions of Group E Occupancies are allowed to have alarms as required for the Group.E Occupancy. See also section 1007.2.12. 7 1532.170 ' Section 1007.2.3 = Fire Alarm Systems, Group .B Occupancies Section 1007.2.3 is amended to include: Group B Occupancies exceeding 6,000 square feet per floor or 12,000 square feet total shall be provided with manual and automatic fire alarm systems. - Mezzanines shall be included in the square footage. 15.32.180 Section 1007.2.8 - Fire Alarm Systems, Group M Occupancies Section 1007.2.8 is amended to include: Group M Occupancies exceeding 6,000 square feet per floor or 12,000 square feet total shall be provided with a manual alarm system. 15.32.190 Section 1007.2.9.1.1— Fire Alarm Systems, New Group R Occupancies, General Section 1007.2.9.1.1 is amended to include: Any mixed use of occupancy which includes R -1 shall be provided with a manual and automatic fire alarm system in accordance with Section 1007.2.9. 15.32.200 Section 1007.3.1 = General System Design and Installation Requirements, Design Standards Section 1007.3.1 is amended to include: Voice alarms and pre- recorded messages shall be approved by the Chief. 15.32.210 Section 1007.3.3.6.1— General System Design and Installation Requirements, Monitoring Section 1007.3.3.6.1 is amended to include: All signals indicating an emergency fire condition shall be transmitted to the fire department in an approved method. 15.32.220. Section 1102.1— Incinerators, Open Burning and Commercial Barbecue Pits, General Section 1102.1 is amended to include: In other than single Family or Duplex Dwellings, the use of solid fuel barbecues is prohibited. 15.32.230 -- Section 1106 = Gas Meters and Piping Section 1106 is amended to include: Where gas meters and piping are subject to damage from snow shedding or ice buildup from a roof area they shall be protected in an approved manner. 15.32.240 Section 1109.7 — Control of Sources of Ignition, Sparks from Chimneys Section 1109.7 is amended to read: Chimneys used with fireplaces or heating appliances in which solid or liquid fuel is used shall be maintained with a spark arrester as required for incinerators'by the Mechanical Code. 15.32.250 Violation The following clause concerning violations is set forth in full and adopted with reference to the Uniform Fire Code and Uniform Fire Codes Standards named in the title of this chapter: It shall be unlawful for any person, firm or corporation to erect, construct, alter, move, demolish, repair, use and occupy,any building or structure and building service equipment, or maintain any building or structure in the Town of Avon or cause or permit the same to be done, contrary to or in violation of any of the provisions of any of the codes or standards named in the title of this ordinance. 15.32.260 Penalty Any person, firm or corporation violating any of the provisions of the Uniform Fire Code or Uniform Fire Code Standards named in the title of this chapter shall be deemed guilty of a misdemeanor, and any such person, firm or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of any of the codes and standards -named in such title of this chapter is committed, continued or permitted and'upon conviction of any such violation, such person, firm or corporation shall be punished by a fine of not more than five hundred dollars or by imprisonment for not more than ninety days, or by both such fine and imprisonment. 15.32.270 Validity If any section, subsection, sentence, clause or phrase of the Uniform Fire Code of Uniform Fire Code Standards named in the title of this chapter, is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining provisions of this ordinance. The Town hereby declares that it would have passed these ordinances, each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections,' subsections, sentences, clauses and phrases be declared unconstitutional.
