AN ORDINANCE AMENDING CHAPTER 10.04 OF THE
MUNICIPAL CODE OF THE TOWN OF AVON RELATING
TO TRAFFIC VIOLATIONS COMMITTED IN SCHOOL
ZONES OR INVOLVING SCHOOL BUSES; AND
PROVIDING PENALTIES FOR THE VIOLATION HEREOF
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON,
COLORADO:
Section 1. Amendment. Section 10.04.100 of Chapter
10.04 of Title 10 of the Municipal Code of the Town of Avon is
amended with the addition of a new section as follows:
of 10.04.100 Section 1415 added to Article I, Part 14 of
the -Model Traffic Code -- School zones - increase of penalties
for moving traffic violations. Article I, Part 14 is amended by
the addition of section 1415, which shall read as follows:
Section 1415. School zones - increase of penalties for
moving traffic violations. (1) Any person who commits a moving
traffic violation in a school zone is subject to increased
penalties and surcharges imposed by section 1701(5).
(2) For purposes of this section, "school zone" means
an area that is designated as a school zone and has appropriate
signs posted indicating that the penalties and surcharges will be
double. The state or local government having jurisdiction over
the placement of traffic signs and traffic control devices in the
school zone area shall designate when the area will be deemed to
be a school zone for the purposes of this section. In making
such designation, the state or local government shall consider
when increased penalties are necessary to protect the safety of
school children.
Section 2. Amendment. Section 10.04.110 of Chapter
10.04 of Title 10 of the Municipal Code of the Town of Avon is
amended with the addition of a new section as follows:
1114.04.110 Section 1903 amended- School bus violations -
increase of penalties for traffic violations. Section 1903 of the
Model Traffic Code is amended by the addition of the following
language:
111903(6)(c). Any person who violates the provisions of
paragraph (a) of subsection (1) of this sections is subject
to increased penalties and surcharges imposed by section
1701(5).
Section 3. Amendment. Section 10.04.120 of Chapter
10.04 of Title 10 of the Municipal Code of the Town of Avon is
amended with the addition of a new section as follows:
1114.04.120 Section 1701 amended - Traffic offenses and
infractions classified - penalties- penalty and surcharge
schedule. Section 1701 of the Model Traffic Code is amended by
the addition of the following language:
111701 (5). The penalty and surcharge schedule imposed
for any moving traffic violation under subparagraph 3 of section
1701 are doubled if the violation occurs within a school zone
pursuant to section 1415 or if a violation of 1903(1)(a) occurs.
Section 4. Severability. If any part, section,
sentence, clause or phrase of this Ordinance is for any reason
held to be invalid, such decision shall not affect the validity
of the remaining portions of this Ordinance; and the Town Council
for the Town of Avon hereby declares it would have passed this
Ordinance and each part, section, sub - section, sentence, clause
or phrase thereof, irrespective of the fact that any one or more
parts, sections, sub - sections, sentences, clauses or phrases be
declared invalid.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND
ORDERED POSTED, this 28 day of July , 1998 and a
public hearing on this Ordinance shall be held at the regular
meeting of the Town Council of the Town of Avon, Colorado on
11 day of August , 1998 at 7:30 p.m. in the
Municipal Building of the Town of Avon, Colorado.
