No. 1998-10 Amending the Chapel Square PUD Ord 96-25 to Establish a Zero Lot Line SetbackTOWN OF AVON �'°- •-- - ORDINANCE NO. 98-10 SERIES OF 1998 AN ORDINANCE AMENDING THE CHAPEL SQUARE • PUD, (ORDINANCE 96-25) TO ESTABLISH A ZERO LOT LINE SETBACK BETWEEN WAL -MART AND BUILDING A, TRACTS B-1 AND �11-2, LOTS 22 AND 22 -A, CHAPEL SQUARE SUBDIVISION, TOWN OF AVON, EAGLE COUNTY, COLORADO, LOCATED EAST OF BEAVER CREEK PLACE WHEREAS, Chapel Square LLC has filed an application, with the Town of Avon to amend the PUD for Chapel Square, Tracts B -1 and B -2, Lots 22 and Lot 22 -A, Chapel Square Subdivision, Town of Avon, to establish a zero lot line setback between Wal -Mart and Building k WHEREAS, after notices required by law, a public hearing was held before the Planning and Zoning Commission of the Town of Avon on July 7, 1998 at which time the applicant and the public were given an opportunity to express their opinions and present certain information and reports regarding the proposed amendment to the Development Plan; and WHEREAS, following said public hearing, the Planning and Zoning Commission forwarded its recommendations regarding the proposed Development Plan to the Town Council of the Town of Avon; and WHEREAS, after notices provided by law, a public hearing was held before this Council on the 28th day of July , 1998, at which time the applicant and the public were given an opportunity to express their opinions regarding the proposed Development Plan-, and WHEREAS, based upon the evidence, testimony, and exhibits, and a study of the Comprehensive Plan of the Town of Avon and of the recommendation of the Planning and Zoning Commission of the Town of Avon, this Council finds as follows: 1. That the proper posting, publication and public notice were provided as required by law for the hearings before the Planning and Zoning Commission and the Town Council of the Town of Avon. 2. That the hearings before the Planning and Zoning Commission and the Town Council were both extensive and complete and that all pertinent facts, matters and issues were submitted at those hearings. 3: That the Development Plan is consistent with the Comprehensive Plan of the Town of Avon, which designates the land use for this area as mixed -use. 4. That the amendment to allow a zero lot line setback is compatible with the surrounding land uses and neighborhood'. NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COLORADO, THAT the amendment to the Chapel'Square PUD to allow j:\ council \ordinanc \chapsgolot.doc a zero lot line setback between Wal-Mart and Building A as depicted on the attached PUD Plan for Chapel Square dated revised 6/4/98 and labeled as Exhibit A to Ordinance 98 -10 is hereby approved subject to the following conditions: 1. Completion of the Wal-Mart facade within two years of issuance of the first TCO within the PUD; 2. Any garden center or other seasonal outdoor display, storage or sales be subject to annual review and approval by staff; 3. Easements for parking, pedestrian and vehicular access, and maintenance be dedicated in conjunction with the approval of the subdivision and 4.
