ORDINANCE NO. 97 -13
SERIES OF 1997
AN ORDINANCE AMENDING THE BROOKSIDE PARK PLANNED
UNIT DEVELOPMENT (PUD) TO LIST` RESTAURANTS AS AN
ALLOWED USE, LOT 1, BROOKSIDE PARK, TOWN OF AVON, EAGLE
COUNTY, COLORADO,
WHEREAS, Riverview Park Associates Inc. has filed an application with the Town of
Avon to amend the Brookside Park PUD to list restaurants as an allowed use; and
WHEREAS, after notices required by law, a public hearing was held before the Planning
and Zoning Commission of the Town of Avon on November 18, 1997, at which time the
applicant and the public were given an opportunity to express their opinions and present certain
information and reports regarding the amended Planned Unit Development; and
WHEREAS, following said public hearing, the Planning and Zoning Commission
forwarded its recommendations regarding the amendment to the Planned Unit Development to
the Town Council of the Town of Avon; and
WHEREAS, after notices provided by law, a public hearing was held before this Council
on the 9 th day of December , 1997, at which time the applicant and the public
were given an opportunity to express their opinions regarding the amended Planned Unit
Development; and
WHEREAS, based upon the evidence, testimony, and exhibits, and a study of the
Comprehensive Plan of the Town of Avon and of the recommendation of the Planning and
Zoning Commission of the Town of Avon, this Council finds as follows:
1. That the proper posting, publication and public notice were provided as required by law
for the. hearings before the Planning and Zoning Commission and the Town Council of
the Town of Avon.
2. That the hearings before the Planning and Zoning Commission and the Town Council
were both extensive and complete and that all pertinent facts, matters and issues were
submitted at those hearings.
3. That the amended Planned Unit Development is consistent with the Comprehensive Plan
of -the Town of Avon
4. That uses permitted by the amended Planned Unit Development are compatible with the
surrounding uses and neighborhood.
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF AVON, COLORADO, THAT the amendment to Brookside Park Planned Unit

Development to list restaurants as an allowed use is hereby approved subject to the following
conditions: '
1. That all development on this property shall conform to the amended Brookside Park
Planned Unit Development titled Site Development Plan and dated received October,28;
1997, and attached hereto as EXHIBIT A, and which establishes the permitted uses,
number of dwelling units, amount of commercial area, locations of buildings, site
improvements and parking requirements.
3. This amendment is to page one of the Brookside Park Planned Development, approved as
Exhibit A to Ordinance 96 -8.- All other conditions of Ordinance 96 -8 and subsequent
pages of Exhibit A shall remain in force for Lot 1, Brookside Park.
INTRODUCED, PASSED, ON FIRST READING, APPROVED AND .ORDERED POSTED,
this 25th day of November ,1997 , and a public hearing shall be held at
the regular meeting of the Town Council of the Town of Avon, Colorado on the
9th day of December 91997 at 5:30 P.M. in the Municipal Building
of the Town of Avon, Colorado.

DEVELOPMENT (PUD) TO LIST RESTAURANTS AS AN ALLOWED,USE,
LOT 1, BROOKSIDE PARK, TOWN OF AVON, EAGLE COUNTY,
COLORADO
A copy of said Ordinance is attached hereto, and is also on file
at the office of the Town Clerk, and may be inspected during
regular business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
