TC Ord. No. 1997-06 Amending Chapel Square PUD Ord. No. 96-25TOWN OF AVON ORDINANCE NO. 97- 6 SERIES OF 1997 AN ORDINANCE AMENDING THE CHAPEL SQUARE PUD, (ORDINANCE 96 -25) TO ALLOW INCREASED BUILDING HEIGHTS AND INCREASE THE NUMBER OF COMPACT PARKING SPACES, ON TRACTS A AND B, LOT 22, BLOCK 2, BENCHMARK AT BEAVER CREEK SUBDIVISION, TOWN OF AVON, EAGLE COUNTY, COLORADO, LOCATED EAST OF BEAVER CREEK PLACE WHEREAS, Palmos Development has filed an application with the Town of Avon to amend the PUD for Chapel Square, Tracts A and B, Lot 22, Block 2, Benchmark at Beaver Creek Subdivision, Town of Avon, to allow increased building heights and additional compact parking spaces: WHEREAS, after notices required by law, a public hearing was held before the Planning and Zoning Commission of the Town of Avon on June 17, 1997 at which time the applicant and the public were given an opportunity to express their opinions and present certain information and reports regarding the proposed amendment to the Development Plan; and , WHEREAS, following said public hearing, the Planning and Zoning Commission forwarded its recommendations regarding the proposed Development Plan to the Town Council of the Town of Avon; and WHEREAS, after notices provided by law, a public hearing was held before this Council on the 8th day of July , 1997, at which time the applicant and the public were given an opportunity to express their opinions regarding the proposed Development Plan; and WHEREAS, based upon the evidence, testimony, and exhibits, and a study of the Comprehensive Plan of the Town of Avon and of the recommendation of the Planning and Zoning Commission of the Town of Avon, this Council finds as follows: I. That the proper posting, publication and public notice were provided as required by law for the hearings before the Planning and Zoning Commission and the Town Council of the Town of Avon. 2. That the hearings before the Planning and Zoning Commission and the Town Council were both extensive and complete and that all pertinent facts, matters and issues were submitted at those hearings. 3. That the amendment to allow increased building heights and increase the number of compact parking spaces is compatible with the surrounding land uses and neighborhood. NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COLORADO, THAT the amendment to the Chapel Square PUD to' allow increased building heights and increase the number of compact parking spaces as depicted in the attached PUD Plan for Chapel Square dated revised 6/3/97 and labeled as Exhibit A to Ordinance 97 -6 is hereby approved subject to the following conditions: 1. The plan specify that underground parking spaces may be reserved for the tenants of Building B and C. 2. The PUD plan is approved subject to completion of technical corrections identified by staff.
