No. 1997-03 Amending the Brookside PUD Lot 11 Eaglebend SubdivisonTOWN OF AVON ORDINANCE NO. 97 - 3 SERIES OF 1997 AN -ORDINANCE AMENDING THE BROOKSIDE PUD, LOT 11) EAGLEWOOD SUBDIVISION, TOWN OF AVON, EAGLE COUNTY, COLORADO, WHEREAS, Resort Concepts Inc., with the permission of Riverside Park Associates Inc., has filed an application with the Town of Avon to amend the Brookside Park PUD, Lot 1, Eaglewood Subdivision, to include eight additional residential units, change the Building Height for Building B to 63 feet, revise building envelopes for Buildings. B and C, the parking and circulation layout, and architecture of the residential buildings, as described on the Development Plan for the Brookside PUD attached hereto as Exhibit A; and WHEREAS, after notices required by law, a public hearing was held before the Planning and Zoning Commission of the Town of Avon on February 18, 1997, at which time the applicant and the public were given an opportunity to express their opinions and present certain information and reports regarding the proposed Development Plan; and WHEREAS, following said public hearing, the Planning and Zoning Commission forwarded its recommendations regarding the revised Development Plan to the Town Council of the Town of Avon; and WHEREAS, after notices provided by law, a public hearing was held before this Council on the 2 2nd day of April , 1997, at which time the applicant and the public were given an opportunity to express their opinions regarding the amended Development Plan; and WHEREAS, based upon the evidence, testimony, and exhibits; and a study of the Comprehensive Plan of the Town of Avon and of the recommendation of the Planning and Zoning Commission of the Town of Avon, this Council, finds as follows: 1. That the proper posting, publication and public notice were provided as required by law for the hearings before the Planning and Zoning Commission and the Town Council of the Town of Avon. 2. That the hearings before the Planning and Zoning Commission and the Town Council were both extensive and complete and that all pertinent facts, matters and issues were submitted at those hearings. 3. That the Development Plan is consistent with the Comprehensive Plan of the Town of Avon, which designates the land use for this area River Residential use. j:\ council \ordinanc\draftord\brookpd2.doc 4. That the structures and uses permitted by the Development Plan are compatible with adjacent existing and proposed land uses, and suitable for the site's specific topography, visibility, drainage, ambient noise levels and access. . NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COLORADO, THAT the Amended Brookside PUD Development Plan is hereby approved subject to the following conditions: 1. Access and parking be re- designed to provide a minimum of 20 feet of back up area for all parking spaces and minimum driveway width of 16 feet in the Building C area. 2. The trail be changed to meet Town Standards and conform to the subdivision plans. 3. Final Grading and Engineering Design including the piping of the irrigation ditch and commitments for phasing of improvements be approved by Town staff. 4. The PUD approval be conditioned upon a revised final plat being submitted and approved by the Town. 5: The PUD Guide be revised to reflect the 63 foot building height requested for Building B's _ ridgeline, as specified on Plan Sheet A2.6, gridline ' 12, and the PUD Guide and. Summary Table be updated to reflect the revised PUD. The maximum height of all other buildings shall be 60 feet. 6. Three deed restricted residential units be provided. The initial sales price of units shall not exceed:- $152,500 -Unit 211, $162,500 -Unit 311, and $172,500- Unit 113. The units shall be subject to a 3 percent price appreciation cap and must be purchased by permanent, full time residents whose income does not exceed 150 percent of annual median household income for Eagle County, with a tiered priority system. A separate agreement outlining the restrictions will be executed. 7. That all development on this property shall conform to the Amended Brookside PUD, Lot 1, Eaglewood Subdivision, which shall be revised to meet all conditions of approval prior to recording 8. The PUD plan is approved subject to completion of technical corrections identified by staff.
