SERIES OF 1996
AN ORDINANCE APPROVING THE LA PIAZZA PUD (PLANNED UNIT
DEVELOPMENT) ESTABLISHING ZONING STANDARDS AND A
DEVELOPMENT PLAN ON A TRACT OF LAND KNOWN AS THE
FOLSON TRACT LOCATED SOUTH OF HIGHWAY 6 AND EAST OF
AVON ROAD, TOWN OF AVON, EAGLE COUNTY, COLORADO
WHEREAS, Danny Brose' optionee, with the consent of owner Craig Folson has filed
an application with the Town of Avon for approval of a planned unit development (PUD)
establishing zoning standards and a site plan for the LaPiazza PUD; and
WHEREAS, after notices required by law, a public hearing was held before the - Planning
and Zoning Commission of the Town of Avon on January 21, 1997, at which time the applicant
and the public were given an opportunity to express their opinions and present certain
information and reports regarding the proposed Development Plan; and
WHEREAS, following said public hearing, the Planning and Zoning Commission
forwarded its recommendations regarding the proposed Development Plan to the Town Council
of the Town of Avon; and
WHEREAS, after notices provided by law, a public hearing was held before this Council
on the day of , 1997, at which time the applicant and the public
were given'an opportunity to express their opinions regarding the proposed Development Plan;
and
WHEREAS, based upon the evidence, testimony, and exhibits, and a study of the
Comprehensive Plan of the Town of Avon and of the recommendation of the Planning and
Zoning Commission of the Town of Avon, this Council finds as follows:
1. That the proper posting, publication and public notice were provided as required by law
for the hearings before the Planning and Zoning Commission and the Town Council of
the Town of Avon.
'2. That the hearings before the Planning and Zoning Commission and the Town Council
were both extensive and complete and that all pertinent facts, matters and issues were
submitted at those hearings.
3. That the Development Plan is consistent with the Comprehensive Plan of the Town of
Avon, which designates the land use for this area as mixed -use.
4. That the structures and uses permitted by the Development Plan are compatible with
adjacent existing and proposed land uses, and suitable for the site's specific topography,
visibility, drainage, ambient noise levels and access.

NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF AVON, COLORADO, THAT the La Piazza P UD Development Plan is hereby
approved subject to the following conditions:
1. That all development on this property shall conform to the approved La Piazza
Development Plan dated and attached. hereto as- EXHIBIT A, and
which establishes the permitted uses, number of dwelling units, amount of
commercial area, locations of buildings,, site improvements and parking requirements.
2. Owner shall provide nine permanent deed restricted "affordable" housing units
intended to be sold or rented for local residents as further outlined in a master deed
restriction agreement to be approved by the Town.
3. Approval of final grading and engineering by Town Staff.
4. The PUD plan is approved subject to completion of technical corrections identified by
staff
INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED
POSTED, this day of , 199 a public hearing shall be
held at the regular meeting of the Town Council of the Town of Avon, Colorado on the
day of , 199 5:30 P.M. in the Municipal Building of
the Town of Avon, Colorado.
