AN ORDINANCE RELATING TO ACTIVITY ON CONSTRUCTION
SITES AMENDING SECTION +6.04.20, SECTION 6.04.060, AND
SECTION 8.24.085 OF THE AVON MUNICIPAL CODE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON,
COLORADO THAT:
I. Section 6.04.020 of the Avon Municipal Code is hereby amended to add the following
definitions:
"Construction Site" means any lot, parcel or tract of land on which, according to the
Avon Municipal Code, work is being performed by person(s) required to register as a
Contractor with the Town.
"Secure Animal Enclosure" means a structure which is suitable to humanely keep and
to prevent the escape of an animal, and has a top, bottom and all sides, which shall not be
construed to mean the open bed of a truck.
2. Section 6.04.060 of the Avon Municipal Code is hereby amended to add the following
subsection:
K. It is unlawful for a dog owner or keeper to allow his or her dog to enter or
remain on a construction site unless it is restrained by a leash, chain or cable of no more
than ten feet in length, or it is contained in a secure animal enclosure.
3. Section 8.24.085 is hereby amended to read as follows:
8.24.085 Limitation of construction activity. Construction and excavation activity which
produces audible noise at the property lines of a lot or parcel on which such activity is
taking place shall be limited to between the hours of nine A.M. and six P.M. on Sundays
and national holidays, and between the hours of seven A.M. and seven P.M. on all other
days. Any construction or excavation activity that produces audible noise at the property
lines of the parcel containing such activity at times other than the hours defined in this
section shall be deemed a public nuisance.
4. Severability. If any part, section, sub - section, sentence, clause or phrase of this
Ordinance is for any reason held to be invalid, such decision shall not affect the validity
of the remaining portions of the Ordinance; and the Town Council for the Town of Avon
hereby declares it would have passed this Ordinance and each part, section, sub - section,
sentence, clause or phrase thereof. irrespective of the fact that any one or more parts,
sections, sub - sections, sentences, cla-.ses or phrases be declared invalid.

ORDERED POSTED,lchis 13th day of August. 1996, and a public hearing shall be held
at the regular meeting of the Town Council of the Town of Avon. Colorado on the 27th
day of August, 1996, at 5:34 P.M. in the Municipal Building of the Town of Avon,
Colorado.

SERIES OF 1996:
AN ORDINANCE RELATING TO ACTIVITY ON CONSTRUCTION SITES
AMENDING SECTION 6.04.20, SECTION 6.04.060, AND SECTION
8.24.085 OF THE AVON MUNICIPAL CODE
A copy of said Ordinance is attached hereto, and is also on file
at the office of the Town Clerk, and may be inspected during
regular business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
