WHEREAS; the Town of Avon., owner of -tract 1%," t;enchmarn - Beaver C'reek.
has filed an application with the Town oi' Avon to rezone Tract a" fi-cr J >Lf to GPE ,
and,
WHEREAS, after public notices provided by !aw, a public bearipL, was held by the
Planning and Zoning Commission of the Town of Avon on t:re 2nd day of January; 1996,
at which time the applicant and the public were given an opportunity to express their
opinions and present certain information and reports regarding the proposed amendment
of the Zone District 'Map, and
WHEREAS_. following said public heariag, the Planning and Zoning Commission
forwarded reports and recommendations on the proposed an endrnent to the Town
Council of the Town of Avon, and
WHEREAS, after public notices provided by law, a public hearing was held
before this Council on the 9th day of January; 19 96, at which time the applicant ad the
public were given an opportunity to express their opinions regarding he proposed
amendment, and
WHEREAS, based upon the evidence, testimori, and exhibits; and a study of the
Comprehensive Plan of the Town of Avor and the `ec3n-imendation of the planning and
Zoning Commission of the Town of Avon, this Council finds as foLows:
1. The proper posting, publication and public notice was providej as required Maw
for the hearings before the Planning and Zoning Commission ;;nd the Town
C.ounc:! ofthe Town o". : von.
2. That the hearings before the Planning and Zoning Commission, and the Town
Council were both extensive and complete and t')at all pertinent facts, matters and
issues were submitted at those hearings.
3. That the proposed rezoning is consistent with the Comprehen -sive Plan of the
Town of Avon.

NOW THEREFORE, HE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF AVON, COLOPAi DO THAT, the anmenrdnnent to the Chapter . , of ti?e
Town of Avon Municipal Code to change the zone district designation of Tract Y
from OLD to GPEH is approved citing the followin <o findings:
1. The zone change is consistent with the development patterns and locations set
forth in the Town of .Avon Comprehensive Flan.
2. The zone change is consistent with the Comprehensive Plan goals and objectives
related to land use and proximity to the town core.,
3 The zone change is consistent with the Comprehensive flan goals and objectives
related to the environment.
4. The zone change is consistent with the Transportation. Plan traffic generation
forecast for this property.
REPEAL: This amendment shall be considered rescinded. and the zone district
designation shall revert to OLD; as of the 9th day of Jar uai -✓, l �} 7 , unless zi srte- soecncc
development plan for Tract Y is approved by the Town of Avon on or before the 9th day
of January, 1997.

HOUSING) A PARCEL OF LAND KNOWN AS TRACT "Y ", BLOCK 1,
BENCHMARK AT BEAVER CREEK, TOWN OF AVON, EAGLE COUNTY,
COLORADO
A copy of said Ordinance is attached hereto, and is also on file
at the office of the Town Clerk, and may be inspected during
regular business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
