SERIES OF 1995
AN ORDINANCE REZONING LOTS 45 & 46, BLOCK 2, BENCHMARK
AT BEAVER CREEK SUBDIVISION, TO PUD, FOR MULTI - FAMILY
RESIDENTIAL AND TIMESHARE CONDOMINIUM DEVELOPMENT,
TOWN OF AVON, EAGLE COUNTY, COLORADO.
WHEREAS, Lakeside Terrace, LLC and Points of Colorado, owners of Lots 45 & 46,
Benchmark at Beaver Creek Subdivision, have filed an application with the Town of Avon to
rezone the property from RHD and PUD to PUD to allow the expansion of the existing Falcon
Point PUD and to include Falcon Point and Lakeside Condominiums within one new PUD and
subdivision to be named Lakeside PUD for timeshare and multi - family residential development;
WHEREAS, a public hearing has been held by the Planning and Zoning Commission of
the Town of Avon, pursuant to notices required by law, at which time the applicant and the public
were given an opportunity to express their opinions and present certain information and reports
regarding the proposed rezoning; and
WHEREAS, following said public hearing, the Planning and Zoning Commission
forwarded reports and recommendations on the proposed rezoning to the Town Council of the
Town of Avon; and
WHEREAS, after notices provided by law, a public hearing was held before this Council
on the 12th day of December, 1995, at which time the applicant and the public were given an
opportunity to express their opinions regarding the proposed rezoning; and
WHEREAS, based upon the evidence, testimony, and exhibits, and a study of the
Comprehensive Plan of the Town of Avon and the recommendation of the Planning and Zoning
Commission of the Town of Avon, this Council finds as follows:
1. The proper posting, publication and public notice were provided as required by law for the
hearings before the Planning and Zoning Commission and the Town Council of the Town
of Avon.
2. That the hearings before the Planning and Zoning Commission and the Town Council
were both extensive and complete and that all pertinent facts, matters and issues were
submitted at those hearings.
3. That the proposed rezoning as Planned Unit Development is consistent with the
Comprehensive Plan of the Town of Avon which designates the area for residential
development.

NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF AVON, COLORADO THAT, the rezoning of Lot 46, Block 2, Benchmark at Beaver Creek
for multi - family residential and time share development for 6 multi - family dwelling units and 94
timeshare units is approved subject to conditions with the following findings:
1. The property is zoned for 6 multi - family residential unit in 3 duplex buildings and 94
timeshare units in two buildings is consistent with the residential land use designation of
the property within the Town Core as designated by the Town of Avon Comprehensive
Plan. The comprehensive Plan encourages permanent and seasonal residential land uses
within this area, which this rezoning promotes.
2. The rezoning conforms to the Comprehensive plan Objective #A2 (a) to promote the
development of infill parcels in the Town Core area.
3. The rezoning promotes the expansion of residential/lodging residential uses on the edge of
the town core area which will help to bring people into the downtown area and support
local businesses there and expand tourist lodging facilities.
AND THIS APPROVAL IS SUBJECT TO THE FOLLOWING CONDITIONS:
1. All development shall conform to the approved PUD Plan which establishes the building
envelopes, parking and driveway areas, landscape plan and building design and height, as
submitted and approved by the Planning and Zoning Commission which is attached to this
ordinance as Exhibit A.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED
POSTED, this 14th day of November, 1995, and a public hearing shall be held at the regular
meeting of the Town Council of the Town of Avon, Colorado on the 12th day of December,
1995, at 7:30 P.M. in the Municipal Building of the Town of Avon, Colorado.
