ORDINANCE NO. 95 -14
SERIES OF 1995
AN ORDINANCE ADOPTING THE UNIFORM ELECTION CODE OF 1992 IN
LIEU OF THE COLORADO MUNICIPAL ELECTION CODE OF 1965 WHEN
PARTICIPATING IN A COORDINATED ELECTION IN EAGLE COUNTY
CONDUCTED BY THE COUNTY CLERK AND RECORDER
WHEREAS, the adoption of Article 20 of Title X of the
Colorado Constitution in 1992 requires all ballot issues to be
voted on during a regular biennial election, a general election,
and an election held on the first Tuesday in November of odd -
numbered years; and
WHEREAS, H.B. 93 -1255 and H.B. 94 -1286 amended the Uniform
Election Code of 1992 to allow governmental jurisdictions to
coordinate their election operations under the direction of the
county clerk and recorder and to permit voters to vote all
candidates, ballot issues, and ballot questions on one ballot;
and
WHEREAS, it is likely that future coordinated elections will
occur on the date of Avon's regular municipal election and
equally likely that Avon ballot issues will need to be voted on
at future general elections; and
WHEREAS, Avon municipal elections are governed by the
Colorado municipal election laws (Title 31) and Chapter III of
the Town of Avon charter; and
WHEREAS, Section 31 -10 -102.7 of the Colorado Revised
Statutes permits any municipality to adopt the provisions of the
Uniform Election Code of 1992 with respect to any municipal
election.
NOW THEREFORE, BE IT ORDAINED by the Town Council of the
Town of Avon, Colorado, that;
SECTION 1. In accordance with the provisions of C.R.S. 31-
10- 102.7, the Town of Avon hereby adopts the Uniform Election
Code of 1992 in lieu of the Colorado Municipal Election Code of
1965 for the purpose of participating in any coordinated election
in Eagle County which is conducted by the county clerk and
recorder.
SECTION 2. The Town Clerk is hereby directed to work with
the Eagle County Clerk and Recorder and other designated election
officials and to take all necessary actions to implement Avon's
portion of the coordinated election in accordance with Article 20
of Title X of the Colorado Constitution, the Uniform Election
Code of 1992, and all other appropriate statutes.
SECTION 3. Nothing in this ordinance shall prohibit the
Town of Avon from conducting a regular municipal election which
is not a part of a coordinated election or a special municipal
election on a ballot question. Such elections shall be conducted
in accordance with the Colorado Municipal Code of 1965.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED
POSTED, this 8th day of August, 1995 and a public hearing on this
Ordinance shall be held at the regular meeting of the Town
Council of the Town of Avon, Colorado on the 22nd day of
August , 1995 at 7:30 P.M. in the Municipal Building of the
Town of Avon, Colorado.

at the office of the Town Clerk, and may be inspected during
regular business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
