SERIES OF 1995
AN ORDINANCE AMENDING CHAPTER 9.12 OF THE MUNICIPAL
CODE OF THE TOWN OF AVON AS IT RELATES TO CONSUMPTION
OF MALT, WINE AND SPIRITUOUS LIQUORS IN PUBLIC PLACES
AND PROVIDING PENALTIES FOR THE VIOLATION HEREOF
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON
as follows:
Section 1. Amendment. Section 9.12.080 of Chapter
9.12, Title 9 of the Municipal
amended to read as follows:
Code of the Town of Avon is
Section 9.12.080 Drinking in streets prohibited.
(a) It is unlawful for any person to consume any malt,
vinous or spirituous liquors or fermented malt beverages upon any
street, alley, sidewalk, park, public building or public parking
lot in the town or in any vehicle upon the streets, alleys,
sidewalks, parks or public parking lots in the town; provided,
(1) It shall not be unlawful for any person to consume any
malt, vinous or spirituous liquor in any such location when a
special events permit has been issued pursuant to article 48,
title 12, Colorado Revised Statutes; and
(2) It shall not be unlawful for persons 21 years of age and
over to consume fermented malt beverages, labeled as "3.2% beer,"
in Nottingham Park in areas permitted for such consumption by the
Recreation Department of the Town.
(b) It is unlawful for any person to possess or have in his
possession or under his control in or upon any street, alley,
sidewalk, park, public building or public parking lot in the
town, any malt, vinous or spirituous liquors or fermented malt
beverages in any container of any kind or description which has
been opened or which is not sealed or upon which the seal is
broken, except in areas permitted pursuant to subsection (a)
hereof. The word sealed means the regular seal applied by the
United States Government over the cap of all malt, vinous or
spirituous liquors or fermented malt beverages.
Section 2. Penalty. Any person, firm or corporation
violating any of the provisions of this Ordinance shall be deemed
guilty of a violation hereof, and upon conviction of any such
violation, such person, firm or corporation shall be punished by
a fine of not more than one thousand dollars or one hundred
eighty days imprisonment, or by both such fine and imprisonment.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED POSTED,
this 22nd day of June, 1995, and a public hearing on this
Ordinance shall be held at the regular meeting of the Town
Council of the Town of Avon, Colorado on the 11th day of July,
1995, at 7:30 P.M. in the Municipal Building of the Town of Avon,
Colorado.

COUNCIL OF THE TOWN OF AVON, COLORADO AT 7:30 P.M. ON THE 11TH
DAY OF JULY, 1995, AT THE TOWN MUNICIPAL BUILDING FOR THE
PURPOSE OF CONSIDERING THE ADOPTION OF ORDINANCE NO. 95 -11,
SERIES OF 1995:
AN ORDINANCE AMENDING CHAPTER 9.12 OF THE MUNICIPAL CODE
OF THE TOWN OF AVON AS IT RELATES TO CONSUMPTION OF MALT,
WINE AND SPIRITUOUS LIQUORS IN PUBLIC PLACES AND PROVIDING
PENALTIES FOR THE VIOLATION HEREOF
A copy of said Ordinance is attached hereto, and is also on file
at the office of the Town Clerk, and may be inspected during
regular business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
This notice is given and posted by order of the Town Council of
the Town of Avon, Colorado
