Pursuant to Section 6.9 of the Charter of the town, there is hereby adopted, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire, hazardous materials or explosion, that certain standards known as the Uniform Fire Code, including appendix chapters: A -I -C Stairway Identification, A -11 -B Protection of Flammable and Combustible Liquids in Tanks in Locations Subject To Flooding, A -II -E Hazardous Materials Management Plans and Hazardous Materials Inventory Statements, Figure A- II -E -1 Hazardous Materials Management Plan Instructions, A -II -F Protected Aboveground Tanks for Motor Vehicle Fuel- dispensing Stations Outside Buildings, A -II -I Ozone Gas - generating Equipment, A -III -C Testing Automatic Sprinkler and Standpipe Systems, A -V -A Nationally Recognized Standards of Good Practice, A -VI -A Hazardous Materials Classifications, A -VI -B Emergency Relief Venting for Fire Exposure for Aboveground Tanks, A -VI -D Reference Tables From the Uniform Building Code, A -VI -E Recommended Separation Distances of Explosive Materials, A -VI -G Unit Conversion Tables, and the Uniform Fire Code Standards published by the Western Fire Chiefs Association, Palm Brook Corporate Center, 3602 Inland Empire Boulevard, Suite B -205, Ontario, California, 91764 and the International Conference of Building Officials, 5360 Workman Mill Road, Whittier, California, 90601, being particularly the 1991 editions thereof and the whole thereof, save and expect such portions as are hereinafter deleted, modified or amended by this ordinance, of which three copies have been and are now filed in the office of the Avon Town Clerk and are available for inspection during normal business hours, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date of which the ordinance codified in this chapter shall take effect. The repeal or the repeal and re- enactment of any provision of the code of the Town of Avon, Colorado as provided in this Ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and re- enacted. The repeal of any provision here shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Health, Safety and Welfare. The town council hereby finds, determines and declares that this chapter is necessary and proper for the health, safety, and welfare of the town and the inhabitants thereof. (Ord. 92 -9 1 (part)). 15.32.020 Additions or Modifications. The Uniform Fire Code is amended and changed in Sections 15.32.030 through 15.32.300. (Ord 92 -9 1 (part)). 15.32.030 Section 104.1.2 -- Authority at Fires and Other Emergencies_ Interference. Section 104.1.2 is amended to include the following: It shall be unlawful for any person to interrupt, silence, or disconnect any signal, or fire alarm system signal which indicates the presence of an emergency fire condition, unless such signal is a signal from maintenance or testing or as approved in writing by the Fire Chief. Fire alarm control panel trouble signals shall not be construed as an emergency fire condition. (Ord. 92 -9 1 (part)). 15.32.040 Section 105.8 -- Permit required. All permits required under this subsection are expressly deleted, save and except the following sections in their entirety. Section 105.8 c.2. Section 105.8 c.7. Section 105.8 c.9. Section 105.8 e.1. Section 105.8 f 2.2. Section 105.8 f 3. Section 105.8 h.1. Section 105.8 1.1. (Ord 92 -9 1 (part)). Carnivals and fairs. Compressed gases. Cryogens. Explosives or blasting agents. Fireworks Flammable or combustible liquids. Hazardous materials. Liquefied petroleum gases. 15.32.050 Section 214 -- Definitions and Abbreviations_ M. Section 214 is amended to include the following: Monitored is the sending of fire alarm signals using circuits installed in accordance with the 1993 edition of National Fire Protection Association Standard 72 to transmit alarm, supervisory and trouble signals from one or more protected premises to an approved remote station monitoring center at which appropriate action is taken. 1532.060 Section 219 -- Definitions and Abbreviations_ R. Section 219 is amended to include the following: Remote Station Monitoring Center is a place to which remote alarm and supervisory signaling devices are connected, and where personnel are in attendance at all times to supervise the circuits, investigate signals and transmit emergency signals to the fire department. A remote station monitoring center shall include central station service. Remote Station Monitoring Center - Dealer is any individual, partnership, corporation or other entity engaged in the selling of central station services for a remote station monitoring center. A dealer may investigate signals for a remote station monitoring center. (Ord. 92 -9 1 (part)). 15.32.070 Section 1001.5.1 -- Fire - Protection Systems and Equipment, Maintenance, General. Section 1001.5.1 is amended to include the following: Automatic sprinkler systems and automatic fire alarm systems shall be inspected and tested at least every 12 months, by approved persons in accordance with this article and nationally recognized standards. Standpipes shall be inspected and tested every 5 years according to guidelines found in NFPA Standard 14, 1993 Edition. Fire alarm systems shall be maintained and tested at least every 12 months, by approved persons in accordance with this article and nationally recognized standards. Prior to any maintenance or test of a fire alarm system which causes a signal to be transmitted to the fire department indicating an emergency fire condition, such transmission shall first be discontinued for the duration of the maintenance or test. The emergency fire signal shall not be discontinued for more than eight (8) hours in any one day and shall not be discontinued beyond 6:00 pm unless otherwise approved by the Fire Chief. All persons performing maintenance or tests shall also notify the fire department of the maintenance or test prior to and at the conclusion of the maintenance or test. (Ord 92 -9 1 (part)). 15.32.080 Section 1003.1. l -- Fire - Extinguishing Systems. Installation Requirements, General. Section 1003. 1.1 is amended to include the following: Adequate protection of automatic sprinkler systems from freeze must be provided and maintained. National Fire Protection Association Standard 13 shall be used as a guide to minimize failures of automatic fire- extinguishing systems due to freeze. Owners, contractors and installers of automatic fire - extinguishing systems shall note the following areas as susceptible to freeze: 1. In the vicinity of the northern and northerly exterior walls of a building. 2. Near an exterior wall in the vicinity of a glass window. 3. In soffits adjacent to an exterior wall. 4. In multiple unit dwellings where temperature regulation may be controlled within individual units. 5. In roof rafter spaces where ceilings are attached directly to structural members, regardless of the amount of insulation. 6. In unheated areas such as attics and garages. 7. In concealed spaces or other areas subject to cold air infiltration. All fire- extinguishing system drawings submitted for approval shall describe the methods used to achieve protection from freeze. (Ord. 92 -9 1 (part)). 15.32.090 Section 1003.2.7 Fire - Extinguishing Systems. Required Installations, Group M. Section 1003.2.7 is amended to: An automatic sprinkler system shall be installed in retail sales rooms classified as Group M Occupancies where the floor area exceeds 5,000 square feet on any floor or 10,000 square feet on all floors or in Group M retail sales occupancies more than two stories in height. The area of mezzanines shall be included in determining the areas where sprinklers are required. (Ord. 92 -9 1 (part)). 15.32. 100 Section 1003.2.8 Fire - Extinguishing Systems, Required Installations_ Group R. Division 1 Occupancies. Section 1003.2.8 is amended to read: An automatic sprinkler system shall be installed throughout every apartment house three or more stories in height or containing 12 or more dwelling units, every congregate residence three or more stories in height or having an occupant load of 20 or more, and every hotel three or more stories in height or containing 20 or more guest rooms. Residential or quick- response standard sprinklers shall be used in dwelling units and guest room portions of the building. (Ord. 92 -9 1 (part)). 15.32.1 10 Section 1003.3.1 Sprinkler System Monitoring and Alarms, Where Required. Section 1003.3.1 is amended to read: All valves controlling the water supply for automatic sprinkler systems and water -flow alarm and trouble signals shall be distinctly different and shall be automatically transmitted to an approved remote station monitor. Exception: Underground key or• huh valves in roadivay boxes provided by the trnnn, district, or piihlic utility need not he .v pervised (Ord. 92 -9 1 (part)). 15.32.120 Section 1004.1.1 -- Standpipes, Installation Requirements_ General. Section 1004. 1.1 is amended to include: In any occupancy other than R3, where fire department vehicular access to within 20 feet of 50% of the exterior perimeter, including access to at least one side of the highest portion of the building is not provided, the Fire Chief may require Class I standpipes in locations as the Chief may deem necessary. Standpipes are required to be dry only, to minimize failure of systems due to freeze. (Ord. 92 -9 1 (part)). 15.32.130 Table No. 1004 -A -- Standpipe Required Systems is amended to read as follows.. Except as otherwise specified in Itern 4 of this table, Class I Standpipes need not be provided in basements having an automatic fire- extinguishing system throughout. 2. The standpipe system may be combined with the automatic sprinkler system. 3. Portions of otherwise sprinklered buildings which are not protected by automatic sprinklers shall have Class I standpipes installed as required for the unsprinklered portions. 4. Class I standpipes need not be provided in assembly areas used solely for worship. (Ord. 92 -9 1 (part)). 15 32 140 Section 1006.2.8--Protection of Commercial Cooking Operations, Operations and Maintenance. Section 1006.2.8 is amended to include the following: Activation of the fire extinguishing equipment shall sound an alarm and shall send a monitored signal to a remote station monitor. The remote station monitor shall notify the fire department in an approved method. Hoods, grease- removal devices, fans and other appurtenances shall be cleaned at intervals necessary to prevent the accumulation of grease. Cleanings shall be recorded, and records shall state the extent, time and date of cleaning. Such records shall be maintained on the premises. Sprinklers used for the protection of fiyers shall be listed for that application and installed in accordance with their listing. Duct work shall be cleaned at intervals necessary to prevent the accumulation of grease by qualified individuals approved by the building official and fire chief. Certification of work performed shall be forwarded to the fire chief on completion. (Ord. 92 -9 1 (part)). 15.32.150 Section 1007.2.1 1 Fire Alarm Systems When Required Section 1007.2.1.1 is amended to include the following: Installation and maintenance of fire alarm systerns shall be in accordance with this article. The regulations contained in this article require the installation of electrically supervised fire alarm systems. All fire alarm systems required by the Fire Code or the Building Code shall be monitored. Voice alarms and pre- recorded messages shall be approved by the fire chief. With written approval by the fire chief, audible alarm signals actuated by heat or smoke sensing fire detectors may be initially annunciated to a constantly attended location provided that the fire alarm control panel is equipped with an approved manual override which signals the entire building upon activation. When automatic fire- extinguishing systems are required under this code, or the building code, such systems shall be connected to the building fire alarm system, and shall annunciate upon activation of the system. When manual pull stations are part of any fire alarm system required in this code, all manual pull stations shall be of the double acting type. (Ord. 92 -9 1 (part)). 15.32.160 Section 1007.2.1.2 Fire Alarm Systems Use of Area Separation Walls to Define Separate Buildings. Section 1007.2.1.2 is amended to include: The number of stories in occupancies other than R3 shall mean all habitable levels of a structure including but not limited to basements, garden levels, mezzanines, lofts and floors. (Ord. 92 -9 1 (part)). 15.32 170 Section 1007.2.2. 1 -- Required Installations Group A Occupancies Section 1007..2.2.1 is amended to read: Group A, Divisions 1, 2, 2.1 and 3 Occupancies shall be provided with a manual fire alarm system and automatic fire alarm system. (Ord. 92 -9 1 (part)). 15.32.180 Section 1007.2.3-- Required Installations Group B Occupancies Section 1007.2.3 is amended to read: Group B Occupancies where the floor area exceeds 5,000 square feet on any floor or 10,000 square feet on all floors shall be equipped with an approved manual and automatic fire alarm system. The area of mezzanines shall be included in determining the areas where fire alarm systems are required. (Ord. 92 -9 1 (part)). 15.3 2.190 Section 1007.2.4. 1 -- Group E Occupancies General Section 1007.2.4.1 is amended to read: Group E Occupancies shall be provided with fire alarm systems in accordance with Section 1007.2.4. Group E, Division 1 Occupancies and Group E, Division 3 Occupancies having an occupant load of 50 or more shall be provided with an approved manual and automatic fire alarm system. (Ord. 92 -9 1 (part)). 15.3 2.200 Section 1007.2.6.1 -- Group H Occupancies, General. Section 1007.2.6.1 is amended to read: Group H Occupancies shall be provided with a fire alarm system where the floor area exceeds 5,000 square on any floor or all floors, and in accordance with this subsection. The fire alarm system shall be both manual and automatic. (Ord. 92 -9 1 (part)). 15,32.2 10 Section 1007.2.9. 1.1 Group R Division 1 Occupancies, System Requirements, General. Section 1007.2.9.1.1 is amended to read: Group R Occupancies shall be provided with fire alarm systems in accordance with Section 1007.2.9. Group R, Division 1 Occupancies shall be provided with a manual and automatic fire alarm system in apartment houses three or more stories in height or containing 12 or more dwelling units, in hotels three or more stories in height or containing 20 or more guest rooms, and in congregate residences three or more stories in height or having an occupant load of 20 or more. See also Section 1007.2.1.2. In any mixed occupancy containing any Group R, Division 1 or Division 3 Occupancies, an automatic and manual fire alarm system shall be provided throughout. For the purpose of this article, area separation walls shall not define separate buildings, and the number of stories in occupancies other than Group R, Division 3 shall mean all habitable levels of a Structure including, but not limited to basements, garden levels, mezzanines, lofts and floors. (Ord. 92 -9 1 (part)). 15.3 2.220 Section 1007.3.3.6.1 -- Monitoring, General Section 1007.3.3.6.1 is arnended to include: All signals indicating an emergency fire condition shall be transmitted to the fire department in an approved method. (Ord. 92 -9 1 (part)). 15.32.230 Section 1102. l -- Incinerators Open Burning and Commercial Barbecue Pits General Section 1 102.1 is amended to include the following: In other than Single Family or Duplex Dwellings, the use of solid fuel barbecue is prohibited. (Ord. 92 -9 1 (part)). 15.32.240 Section 1 106- -Gas Meters and Piping Section 1106 is amended to include the following: In other than single family dwellings, individual gas meters shall be identified with a fixed tag approved by the building official and fire chief indicating the unit serviced by that meter. Identification shall be by unit number. (Ord. 92 -9 1 (part)). 15.32.250 Section 1 109.6- -Hot Ashes and Spontaneous Ignition Sources Section 1109.6 is amended to include: Metal or noncombustible containers are required to be used in conjunction with commercial dumpsters for the purpose of separating hot ashes, cinders, and smoldering coals from other refuse. Hot ashes, cinders, smoldering coals or greasy or oily materials subject to spontaneous ignition shall not be deposited in containers except as described herein. (Ord. 92 -9 1 (part)). 15.32.260 Section 1 109.7 -- Sparks from Chimneys Section 1109.7 is amended to read: Chimneys used with fireplaces or heating appliances in which solid or liquid fuel is used shall be maintained with a spark arrestor as required for incinerators by the Mechanical Code. (Ord. 92 -9 1 (part)). 1532.270 Section 1 1 12.2.3-- Maintenance of Fire Resistive Construction Identification Section 1112,23 is amended to read as follows: When required by the Chief, a sign shall be displayed permanently near or on each required fire door in letters not less the 1 inch high to read as follows: FIRE DOOR KEEP CLOSED (Ord. 92 -9 1 (part)). 15.32.280 Violation. The following clause concerning violations is set forth in full and adopted with reference to the Uniform Fire Code and Uniform Fire Code Standards named in the title of this chapter: It shall be unlawful for any person, firm or corporation to erect, construct, alter, move, demolish, repair, use and occupy any building or structure and building service equipment, or maintain any building or structure in the Town of Avon or cause or permit the same to be done, contrary to or in violation of any of the provisions of any of the codes or standards named in the title of this ordinance. (Ord. 92 -9 1 (part)). 15.32.290 Penalty. Any person, firm or corporation violating any of the provisions of the Uniform Fire Code or Uniform Fire Code Standards named in the title of this chapter shall be deemed guilty of a misdemeanor, and any such person, firm or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of any of the codes and standards named in the title of this chapter is committed, continued or permitted and upon conviction of any such violation, such person, firm or corporation shall be punished by a fine of not more than five hundred dollars or by imprisonment for not more than ninety days, or by both such fine and imprisonment. (Ord. 92 -9 1 (part)). 15.32.300 Validity. If any section, subsection, sentence, clause or phrase of the Uniform Fire Code or Uniform Fire Code Standards named in the title of this chapter, is for nay reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining provisions of this ordinance. The town hereby declares that it would have passed these ordinances, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
