AN ORDINANCE REPEALING AND REENACTING CHAPTER 15.20
OF THE AVON MUNICIPAL CODE; ADOPTING BY REFERENCE
THE "UNIFORM PLUMBING CODE ", 1994 EDITION
NOW, THEREFORE, BE IT ORDAINED, BY THE TOWN COUNCIL OF
THE TOWN OF AVON, STATE OF COLORADO, THAT:
Chapter 15.20 of the Municipal Code of the Town of Avon is hereby repealed and
reenacted to read as follows:

15.20.010 ADOPTION. The charter of the Town of Avon, Section 6.9 provides
that standard codes may be adopted by reference, with amendments. The Town hereby
adopts the 1994 Edition of the Uniform Plumbing Code and all appendix chapters thereto.
The Uniform Plumbing Code 1994 Edition is published by the International Association of
Plumbing and Mechanical Officials, 2001 Walnut Drive South, Walnut, California, 91789-
2825. Three copies of the Uniform Plumbing code 1994 Edition are on file in the office of
the Town Clerk of the Town of Avon and are available for inspection during regular office
hours.
15.20.020 ADDITIONS OR MODIIFICATIONS. The Uniform Plumbing
Code, 1994 Edition is amended and changed as described in Sections 15.20.030 through
15.20.100.
15.20.030 SECTION 103.4.1 PERMIT FEES. Section 103.4.1 is hereby
amended to read as follows:
103.4.1 Permit Fees. The fee for each permit shall be as set forth in Table 1 -A of
the Uniform Building Code, 1994 Edition.
15.20.040 SECTION 604.2 COPPER TUBE. Section 604.2 is deleted and
replaced by the following.
604.2 Copper tube for water piping shall have a weight of not less than Type L.
EXCEPTION:
1. Type M copper tubing may be used for water piping when piping is above
ground in, or on, a building.
2. Copper tube when used underground shall not be less than Type K.
15.20.050 SECTION 603 CROSS - CONNECTION CONTROL. Section
603.0 is amended by adding the following to the second paragraph:
A reduced pressure backflow prevention device will be required on all fire service
lines at the connection to the domestic water line.
15.20.060 SECTION 605.0 VALVES. Section 605.0 is amended by adding the
following.
605.8. A main shut off valve on the water service line shall be provided at the
property line.
15.20.070 SECTION 608.2 EXCESSIVE WATER PRESSURE. Section 608.2
first sentence is revised as follows:
An approved type pressure regulator preceded by an adequate strainer shall be
installed and the static pressure reduced to eighty (80) pounds per square inch (551 kPa)
or less.
15.20.080 SECTION 609 INSTALLATION. Section 609 last sentence is revised
to read as follows:
The minimum cover shall be seven (7) feet below finish grade.
15.20.090 SECTION 402 WATER CONSERVATION.
Section 402.0 is amended by adding the following:
402.3 Except as specifically provided under Section 402.5, no construction or
renovation of residential structures or of facilities for human use within office, commercial,
or industrial buildings shall be commenced within the Town of Avon which does not
comply with the provisions of this article.
1. For the purpose of this article, "residential structures" includes, but is not
limited to, one and two - family residences, townhouses, condominiums, apartment
buildings, hotels and motels, manufactured housing as defined in Section 40 -10 -104 (3 )
C.R.S., and mobile homes defined as any wheeled vehicle, exceeding either eight feet in
width or thirty -two feet in length, excluding towing gear and bumpers, without motive
power, which is designed and commonly used for occupancy by persons for residential
purposes, in either temporary or permanent locations, and which may be drawn over the
public highways by a motor vehicle. For the purposes of this article "renovation" includes
any addition, replacement, or alteration to an existing residential structure or to a facility
for human use within an office, commercial, or industrial building, where plumbing fixtures
and fittings are installed as part of the renovation. Limited renovation may not be the
basis for a comprehensive or broader change in plumbing fixtures.
2. No building permit shall be issued for the construction.or renovation of a
residential structure or a facility for human use within an office, commercial, or industrial
structure by the Town of Avon unless the fittings and fixtures installed during such
construction or renovation conform to the specifications provided in subsection (3) of this
section.
3 . The requisite fixtures and fittings for such construction and renovation shall be:
A. Except in the case of flushometer valves, tank -type water closets which flush
with a maximum of three and one -half gallons of water;
B. Shower heads for bathing which have a maximum flow capacity of three
gallons per minute at eighty pounds per square inch; and
C. Lavatory faucets and sink faucets which have a maximum flow capacity of two
and one -half gallons per minute at eighty pounds per square inch.
402.4 For facilities for human use within office, commercial, and industrial
structures, the plumbing contractor or party responsible for the installation of said water
flow control fixtures and fittings shall certify to the Town of Avon that the fixtures and
fittings conform with the volume and ratio of water flow to gallons per minute stipulated
by Section 402.3. In lieu of such certification, the result of tests performed by an
approved independent testing laboratory or the manufacturer, using established principles
of mechanics, shall be acceptable.
402.5 The Building Official of the Town of Avon shall waive compliance with the
requirements of this article upon satisfactory demonstration by a petitioner upon their own
motion that the water conservation requirements specified in this article are detrimental to
the public health or safety. Such a waiver shall also be granted if the Building Official
determines that the requisite fixtures and fittings would cause a sewer hydraulic gradient
insufficient to handle reduced water flows.
15.20. 100 SECTION 507.0 COMBUSTION AIR. Section 507.2 first sentence
is amended to read as follows:
All buildings within the Town of Avon shall be considered to be of unusually tight
construction, and all combustion air shall be obtained from the outside.
15.20.110 VIOLATION. The following clause concerning violations is set forth
in full and adopted with reference to the Uniform Plumbing Code named in the title of this
chapter:
It shall be unlawful for any person, firm or corporation to erect, construct, alter,
move, demolish, repair, use and occupy any building or structure and building service
equipment, or maintain any building or structure in the Town of Avon or cause or permit
the same to be done, contrary to or in violation of any of the provisions of any of the
codes or standards named in the title of this ordinance.
15.20.120 PENALTY. Any person, firm or corporation violating any of the
provisions of the Uniform Plumbing Code named in the title of this chapter shall be
deemed guilty of a misdemeanor, and any such person, firm, or corporation shall be
deemed guilty of a separate offense for each and every day or portion thereof during
which any violation of any of the provisions of any of the codes and standards named in
the title of this chapter is committed, continued or permitted, and upon conviction of any
such violation, such person, firm or corporation shall be guilty of a misdemeanor and
punishable by a fine of not more than $1,000.00 or 90 days imprisonment, or both.
15.20.130 REPEAL The repeal or the repeal and the re- enactment of any
provision of the Code of the Town of Avon, Colorado as provided in this Ordinance shall
not effect any right which has accrued, any duty imposed, any violation that occurred prior
to the effective date hereof, any prosecution commenced, nor any other action or
proceeding as commenced under or by virtue of the provision repealed or repealed and re-
enacted. The repeal of any provision hereby shall not revive any provision or any
ordinance previously repealed or superseded unless expressly stated herein.
15.20.140 VALIDITY. That if any section, subsection, sentence, clause, or
phrase of the Uniform Plumbing Code named in the title of this chapter, is for any reason,
held to be invalid or unconstitutional, such decision shall not affect the validity or
constitutionality of the remaining provisions of these ordinances, and each section,
subsection, clause or phrase thereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses and phrases be declared unconstitutional.

on this ordinance shall be held at the regular meeting of the Town Council of the Town of
Avon, Colorado on the 28th day of February, 1995 at 7:30 P.M. in
the Municipal Building of the Town of Avon, Colorado.

Following this hearing, the Council may consider final passage of
this Ordinance.
