No. 1995-03 Repealing and reenacting Chapter 15.12 of the Avon Muni CodeTOWN OF AVON ORDINANCE NO. 95 -3 SERIES OF 1995 AN ORDINANCE REPEALING AND REENACTING CHAPTER 15.12 OF THE AVON MUNICIPAL, CODE: ADOPTING BY REFERENCE THE "NATIONAL ELECTRICAL CODE ", 1993 EDITION NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, STATE OF COLORADO, THAT: Chapter 15.12 of the Municipal Code of the Town of Avon is hereby repealed and reenacted to read as follows: CHAPTER 15.12 NATIONAL ELECTRICAL CODE SECTIONS: 15.12.010 ADOPTION 15. 12.020 ADDITIONS OR MODIFICATIONS 15.12.030 DELETION OF TABLE NO. 3 -A ELECTRICAL PERMIT FEES 15.12.040 AMENDMENTS TO THE NATIONAL ELECTRICAL CODE 1.5.12.050 SECTION 203 - - LIABILITY OF BOARD MEMBERS 15.12.060 ELECTRICAL PERMIT FEES 15.1 2.070 VIOLATION 15.12.080 PENALTY 15.12.090 VALIDITY NATIONAL ELECTRICAL CODE 15.12.010 ADOPTION. The Charter of the Town of Avon, Section 6.9 provides that standard codes may be adopted by reference, with amendments. The Town of Avon hereby adopts the 1993 Edition of the National Electrical Code and all appendix chapters thereto. The National Electrical Code is published by the National Fire Protection Association, Batterymarch Park, Quincy, MA 02269. Three copies of the National Electrical Code are on file in the office of the Town Clerk of the Town of Avon and are available for inspection during regular office hours. 15.12.020 ADDITIONS OR MODIFICATIONS. The National Electrical Code is amended and changed in Sections 15.12.030 through 15.12.060. 15.12.030 DELETION OF TABLE NO. 3 -A - ELECTRICAL PERMIT FEES. Table No. 3 -A Electrical Permit Fees is deleted. 15.12.040 AMENDMENTS TO THE NATIONAL ELECTRICAL CODE: The following amendments are hereby made to the National Electrical Code, 1993 Edition. A. All electrical wiring in Groups A, B, E, F, H, I, M, R, S, and U occupancies as defined in the Uniform Building Code, shall be encased in conduits, raceways, or an approved armor. All wiring in Group R shall be encased in conduit raceways, or in approved armor to the circuit breaker box for each unit. No aluminum wire or copper clad aluminum wire smaller than size 8 will be permitted within the Town of Avon. B. Persons engaged in the installation of remote control, low energy power, and signal circuits as defined in Article 725 and 760 of this code, need not be licensed themselves pursuant to Title 12 Article 23, Colorado Revised Statutes, nor work under the supervision of such licensed electricians However, all such persons shall register with the State Electrical Board. Proof of registration shall be produced by the registrant to the Town of Avon Building Official. C. All such installations of remote control, low energy power and signal systems are subject to the permit and inspection set forth in 12-23-116 C.R.S. Accordingly, all installations of remote control, low energy power and signal systems must be performed in accordance with the minimum standards set forth in the National Electrical Code. 15.12.050 SECTION 203 -- LIABILITY OF BOARD MEMBERS. Section 203 is amended by adding the following: (c) Any members of the Board provided for herein, acting in good faith and without malice for the Town of Avon in the discharge of their duties, shall not thereby render themselves personally liable. The members are hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act or omission related to the discharge of their duties. Any suit brought against a member or members of the board as provided herein, because of such act or omission performed by them in the discharge of their duties, shall be defended by the Town of Avon until final termination of the proceedings. 15.12.060 ELECTRICAL PERMIT FEES. Electrical permit fees shall be as follows: ELECTRICAL PERMIT FEES Residential: This includes modular homes, mobile homes, also duplexes and condominiums and townhouses: Construction and extensive remodeling and additions to (based on enclosed living area) Not more than 1,000 square feet ........... ............................... $40.00 Over 1,000 square feet and not more than 1,500 square feet .................. ............................... $60.00 Over 1,500 square feet and not more than 2,000 square feet .................. ............................... $75.00 Per 100 square feet in excess of 2,000 square feet... .......................................................... $ 5.00 All other fees, except for inspection in mobile homes and travel trailer parks, shall be computed on the dollar value of the electrical installations, including fixtures and installation, including time and material (total cost to the customer), and such fees shall be computed as follows: Valuation of work: (Actual cost to customer) Labor and Materials: Not more than $ 300. 00 ........... ............................... $35.00 More than $300.00 but not more than $2, 000. 00 ............... ............................... $40.00 More than $2,000.00 but not more than $50, 000. 00 ............. ............................... $16.00 per thousand or fraction thereof of total valuation More than $50,000.00 but not more than $500,000.00 ................. ...................... $15.00 per thousand or fraction thereof of total valuation PLUS $50.00 More than $500,000.00, ...................... . ... .... $14.00 per thousand or fraction thereof total valuation plus $550.00 Mobile homes and travel parks per space ................. ............................... ... $; 5.00 Reinspection on all above ........ ............................... $44.00 Temporary power inspections ............................... $30.00 per each 15.12.070 VIOLATION. The following clause concerning violations is set forth in full and adopted with reference to the National Electrical Code named in the title of this chapter It shall be unlawful for any person, firm or corporation to erect, construct, alter, move, demolish, repair, use and occupy any building or structure and building service equipment, or maintain any building or structure in the Town of Avon or cause or permit the same to be done, contrary to or in violation of any of the provisions of any of the codes or standards named in the title of this ordinance. 15.12.080 PENALTY. Any person, firm or corporation violating any of the provisions of the National Electrical Code named in the title of this chapter shall be deemed guilty of a misdemeanor, and any such person, firm, or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of any of the codes and standards named in the title of this chapter is committed, continued or permitted, and upon condition of any such violation, such person, firm or corporation shall be guilty of a misdemeanor and punishable by a fine of not more than $1,000.00 or 90 days in jail or both. 15.12.090 VALIDITY. That if any section, subsection, sentence, clause or phrase of the National Electrical Code named in the title of this chapter, is for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining provisions of these ordinances. The Town of Avon hereby declares that it would have passed these ordinances, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
