No. 1994-16 Amending Chapter 9.12 prohibiting drinking in streetsORDINANCE NO. 94-16 COLORADO: AN ORDINANCE AMENDING CHAPTER 9.12 OF THE MUNICIPAL CODE OF THE TOWN OF AVON PROHIBITING DRINKING IN STREETS; AND PROVIDING PENALTIES FOR THE VIOLATION HEREOF BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, Section 1. Amendment. Section 9.12.080 of Chapter 9.12 of Title 9 of the Municipal Code of the Town of Avon is amended with the addition of a new section as follows: 9.12.080 Drinking in Streets Prohibited. It is unlawful for any person to drink any malt, vinous, or spirituous liquors upon any street, alley, sidewalk, park, public building or public parking lot in the town or in any vehicle upon the streets, alleys, sidewalks, parks, or public parking lots in the town except by written authorization of the liquor licensing authority. It is unlawful for any person to possess or have in his possession or under his control in or upon any street, alley, sidewalk, park, public building or public parking lot in the town, any malt, vinous, or spirituous liquors in any container of any kind or description which is not sealed or upon which the seal is broken. The word sealed means the regular seal applied by the United States Government over the cap of all malt, vinous or spirituous liquors. Section 2. Severability. If any part, section, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance; and the Town Council for the Town of Avon hereby declares it would have passed this Ordinance and each part, section, sub-section, sentence, clause or phrase thereof, irrespective of the fact that any one or more parts, sections, sub-sections, sentences, clauses or phrases be declared invalid. Section 3. Penalty. It is unlawful for any person to violate any provision of, or to fail to comply with any of the requirements of, this Ordinance. Any person who violates any of the provisions of this Ordinance shall be punished by a fine of not more than one thousand dollars or by imprisonment for a period not more than one hundred eighty days or both such fine and imprisonment; provided, no person under the age of eighteen years shall be punished by imprisonment.
