No. 1990-07• a TOWN OF AVON ORDINANCE NO. 90 - 7 SERIFS OF 1990 AN ORDINANCE AMENDING THE WILDRIDGE SPA PLAN BY THE TRANSFER OF ONE RESIDE14TIAL DEVELOPMENT RIGHT FROM LOT 37, BLOCK 1, WILDRIDGE SUBDIVISION, TO LOT 89, BLOCK 1, WILDRIDGE SUBDIVISION WHEREAS, Mr. Kenneth Sortland, the owner of Lot 87, Block 1, and Lot 89, Block 1, Wildridge Subdivision, has requested a Zoning Amendment to amend the Wildridge SPA Plan by the transfer of one residential right from Lot 87, Block 1, Wildridge Subdivision to Lot 89, Block 1, Wildridqe Subdivision; and WHEREAS, the transfer of residential development rights in a SPA Zone District requires a Zoning Amendment; and WHEREAS, a public hearing has been held by the Planning and Zoning Commission of the Town of Avon, pursuant to notices required by law; and WHEREAS, following such public hearing the Planning and Zoning Commission forwarded reports and recommendations on the proposed Amendment to the Town Council; and WHEREAS, as provided by law a public hearing was held before the Town Council on the 26th day of June, 1990, at which time the applicant and the public were given an opportunity to express their opinions regarding the proposed amendment; and WHEREAS, the Avon Town Council has determined that the proposed SPA Amendment is: 1. Consistent with the objectives and purposes of the zoning code; and 2. Deemed compatible with surrounding land uses and uses in the area. NOW, THEREFORE, BE IT ORDAINED, by the Town Council of the Town of Avon, Colorado, that: The Wildridge SPA Plan shall be and is hereby amended by the transfer of one development right from Lot 87, Block 1, Wildridge Subdivision to Lot 89, Block 1, Wildridge Subdivision. Hereafter Lot 87, Block 1, Wildridge Subdivision shall be assigned three residential development rights and Lot 89, Block 1, Wildridge Subdivision is hereby assigned five residential development rights. INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED POSTED, this 26th day of June, 1990, and a public hearing shall be held at the regular meeting of the Town Council of the Town of Avon, Colorado on the 10th day of Julv, 1990 at 7:30 P.M. in the Municipal Building of the Town of Avon, Colorado. A copy of said Ordinance is attached hereto, and is also on file at the office of the Town Clerk, and may be inspected during regular business hours. Following this hearing the Council may consider final passage of this Ordinance.
