ORDINANCE NO. 89 - 6
AN ORDINANCE AMENDING SECTION 9.08.030
OF THE MUNICIPAL CODE OF THE TOWN OF
AVON AS IT RELATES TO THE DEFINITION OF
LARCENY; AND PROVIDING A PENALTY FOR THE
VIOLATION HEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON, COLORADO:
Section 1. Amendment. Subsection A of Section
9.08.030 of Chapter 9.08 of Title 9 of the Municipal Code of

the Town of Avon is amended to read as follows:

"A. 'Larceny' means to take or exercise
control over property of another having a value of
less than three hundred dollars, without au-
thorization or by threat or deception; and:
1. With the intention to deprive the
owner permanently of the use or benefit of
i! such property; or
2. To knowingly use, conceal or abandon
such property in a manner so as to deprive
the owner permanently of its use or benefit;
or
3. To use, conceal or abandon such
property intending that such use concealment
or abandonment will deprive the owner perma-
nently of its use and benefit; or
;i 4. To demand any consideration for
which one is not legally entitled as a
condition or restoring such property to the
i owner."

Section 4. Penalty for Violation . Any person,
I firm or corporation violating any of the provisions of this
Ordinance shall be deemed guilty of a violation of this
Ordinance and any such person, firm or corporation shall be
deemed guilty of a separate offense for each and every day
or portion thereof during which any violation is committed,

continued or permitted, and upon conviction of any such
j violation, such person, firm or corporation shall be pun-
,I ished by a fine of not more than $500.00 or by imprisonment
for not more than 90 days, or by both such fine and impris-
onment.

NOTICE IS HEREBY GIVEN OF A PUBLIC HEARING BEFORE THE TOWN COUNCIL
OF THE TOWN OF AVON, COLORADO, AT 7:30 P.M. ON THE 14TH DAY OF
MARCH, 1989, AT THE TOWN HALL FOR THE PURPOSE OF CONSIDERING
THE ADOPTION OF ORDINANCE NO. 89-6, SERIES OF 1989:
AN ORDINANCE AMENDING SECTION 9.08.030 OF THE MUNICIPAL CODE
OF THE TOWN OF AVON AS IT RELATES TO THE DEFINITION OF LARCENY;
AND PROVIDING A PENALTY FOR THE VIOLATION HEREOF.
A copy of said Ordinance is attached hereto, and is also on file
at the office of the Town Clerk, and may be inspected during
regular business hours.
Following this hearing the Council may consider final passage
of this Ordinance.
This notice is given and published by order of the Town Council
of the Town of Avon, Colorado.
