IS the Zoning Map amended as it pertains to the property described on Exhibit A hereto; and U & WHEREAS, public hearings have been held by the Planning C; and Zoning Commission of the Town of Avon g pursuant to notices required by law, at which the applicant and the public were given an opportunity to express their opinions regarding the proposed U] LL amendment; and o WHEREAS, based upon the evidence, testimony and exhibits, to u and a study of the Master Plan of the Town of Avon and the recommendations of the Planning and Zoning Commission of the Town to J of Avon, this Council finds as follows: 6 U > z 1. S' w s+ z 3. The proposed amendment to the Zoning Map of the Town m z 0) o of Avon is consistent with the Master Plan of the Town of Avon. fti 4. The requested amendment to the Zoning Map of the Town of Avon will be in the best interest of the health, safety, Welfare, and morals of the citizens of the Town of--Avon. NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, AS FOLLOWS: 0 • Section 1. Specially Planned Area Plan. The land uses permitted within the area described on Exhibit A hereto, and the regulations affecting such area and the respective divisions of land within such area as described on Exhibit A, shall be those attached hereto as Exhibit B, together with such other provisions of the Municipal Code of the Town of Avon(including but not limited to the Subdivision Code and the Zoning Code) as are not in conflict with the regulations and limitations in Exhibit B. Section 2. Effective Date. The Specially Planned area Plan for the property described as Exhibit A, and the Zoning Map of the Town of Avon provided for herein, shall take effect in accordance with the charter and the ordinances of the Town of Avon, and the Mayor and the Town Clerk are hereby directed and authorized to execute such documents as may be required to reflect 4 the amendment herein authorized, and to file a certified copy of such document with the Clerk and Recorder for Eagle County, Colorado.
