No. 1988-18r • TOWN OF AVON ORDINANCE NO. 88 - 18 SERIES OF 1988 AN ORDINANCE AMENDING THE WILDRIDGE SPA PLAN BY THE TRANSFER OF ONE RESIDENTIAL DEVELOPMENT RIGHT FROM LOT 64, BLOCK 4, WILDRIDGE SUBDIVISION, TO LOT 23, BLOCK 4, WILDRIDGE SUBDIVISION AND THE TRANSFER OF ONE RESIDENTIAL DEVELOPMENT RIGHT FROM LOT 64, BLOCK 4, WILDRIDGE SUBDIVISION TO LOT 23, BLOCK 1, BENCHMARK AT BEAVER CREEK SUBDIVISION WHEREAS, Section 36, Inc., owners of Lot 64, Block 4, and Lot 23, Block 4, Wildridge Subdivision have requested a Zoning Amendment to amend the Wildridge SPA Plan by the transfer of one residential development right from Lot 64, Block 4, Wildridge Subdivision, to Lot 23, Block 4, Wildridge Subdivision, and the transfer of one residential development right from Lot 64, Block 4, Wildridge Subdivision to Lot 23, Block 1, Benchmark At Beaver Creek Subdivision; and WHEREAS, the transfer of residential development rights in a SPA Zone District requires a Zoning Amendment; and WHEREAS, a public hearing has been held by the Planning and Zoning Commission of the Town of Avon, pursuant to notices required by law at which the applicant and the public were give an opportunity to express their opinions and present certain information and reports regarding the Zoning Amendment; and WHEREAS, following such public hearing the Planning and Zoning Commission forwarded reports and recommendations on the proposed Amendment to the Town Council; and WHEREAS, as provided by law a public hearing was held before the Council on the 13th day of December at which time the applicant and the public were given an opportunity to express their opinions regarding the proposed amendment; and WHEREAS, the Town of Avon Council and the Planning and Zoning Commission have determined that the proposed zone change is: 0 0 1. Consistent with the objectives and purposes of the Zoning Code; and 2. Deemed compatible with surrounding land uses and uses in the area. NOW, THEREFORE, BE IT ORDAINED, by the Town Council of the Town of Avon, Colorado that: The Wildridge SPA Plan shall be and is hereby amended by the transfer of one residential development right from Lot 64, Block 4, Wildridge Subdivisicn to Lot 23, Block 4, Wildridge Subdivision to Lot 23, Block 4, Wildridge Subdivision and the transfer of one residential development right from Lot 64, Block 4, Wildridge Subdivision to Lot 23, Block 1, Benchmark at Beaver Creek Subdivision. Hereafter, Lot 64, Block 41 Wildridge Subdivision shall be assigned two (2) residential development rights, Lot 23, Block 4, Wildridge Subdivision shall be assigned three (3) residential development rights with the stipulation that these development rights may not be fractionalized, and no more than two residential units inay be constructed within the present boundaries of Lot 23, Block 4, Wildridge Subdivision. Lot 23, Block 1, Benchmark at Beaver Creek is hereby assigned one (1) residential development right.
