ORDINANCE NO. 87-9
SERIES OF 1987
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE
ZONING MAP OF THE TOWN OF AVON BY THE INCLUSION
OF CERTAIN PROPERTY KNOWN AS NOTTINGHAM STATION
SUBDIVISION
WHEREAS, Nottingham Ranch Company, and Nottingham
Associates, each a partnership, has filed application with
the Town of Avon to amend the zoning district map, to zone
the property described on the Final Subdivision Plat
known as Nottingham Station subdivision of the Town of Avon;
and
WHEREAS, the Town of Avon desires to desigante
zoning Districts applicable to each of the parcels as
described on the Final Subdivision Plat known as
Nottingham Station Subdivisibn-;. and to amend the Zoning
Map to reflect such designations; and
WHEREAS, purusant to Ordinance No. 79-12, public
hearings have been held by the Planning and Zoning Commission
of the Town of Avon, at which the applicant and the public
were given an opportunity to express their opinions regarding
the proposed amendment, and as a result thereof has
recommended that the parcels be zoned as:
Lot 1 - NC(Neighborhood Commercial)
Lot 2 - NC(Neighborhood Commercial)
Lot 3 - SPA per Ordinance No. 82-2
Tracts A, B - SPA with allowed uses of open space,
landscaping, drainage, signage, access and,
utilities; and
WHEREAS, following such public hearings, the Planning
and Zoning Commission forward reports and recommendations on
the proposed amendment to the Town Council; and
WHEREAS, after notices provided by law, a public
hearing was held before this Council on the 11th day of October
1988, at which time the applicant and the public were given an
opportunity to express their opinions regarding the proposed
amendment; and
WHEREAS, based upon the evidience, testimony, and
exhibits, and a study of the Master Plan of the Town of Avon
and the recommendations of the Planning and Zoning Commission
of the Town of Avon, this Council finds as follows:

1. The proper posting, publication and public notice
was provided as required by law for the hearings before this
Planning and Zoning Commission and the Town Council of the
Town of Avon.
2. That the hearings before the Planning and Zoning
Commission and the Town Council were both extensive and
complete and that all pertinent facts, matters and issues
were submitted at those hearings.
3. That-the proposed amendment to the Zoning
District Map of the Town of Avon is consistent with the
Master Plan of the Town of Avon.
4. That the requested amendment to the Zoning
District Map of the Town of Avon will be in the best interest
of the health, safety, welfare and morals of the citizens of
the Town of Avon.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF'AVON, COLORADO, THAT:
1. Amendment to Zoning District Map.
The Zoning District Map of the Town of Avon shall be
and hereby is amended to reflect that the certain real
property is hereby zoned as follows:
Lot 1 - NC (Neighborhood Commercial)
Lot 2 - NC (Neighborhood Commercial)
Lot 3 - SPA per Ordinance No. 82-2
Tracts A, B - SPA with allowed uses of open space,
landscaping, drainage, signage, access and
utilities,
shall be and hereby is included in the Zone District Map
and subject to all the terms and conditions thereof set
forth in the Municipal Code of the Town of Avon, as may
from time to time be in effect, and the uses, purposes and
dimensions shall be as set forth on the Nottingham Station
Subdivision Final Plat.
2. Effective Date.
- The amendment to the Zoning District Map of the Town
of Avon provided for herein shall take effect in accordance
with the charter and the ordinances of the Town of Avon, and
the Mayor and the Town Clerk are hereby directed and
authorized to execute such documents as may be required to
reflect the amendment herein authorized, and to file a
certified copy of such documents with the County Clerk and
Recorder of Eagle County, Colorado.
