No. 1986-22TOWN OF AVON • ORDINANCE NO. 86-22 SERIES OF 1986 AN ORDINANCE REPEALING CHAPTER 15.32 OF THE AVON MUNICIPAL CODE AND REENACTING CHAPTER 15.32 OF THE AVON MUNICIPAL CODE ADOPTING BY REFERENCE THE "UNIFORM FIRE CODE", 1985 EDITION, AND PROVIDING A PENALTY FOR VIOLATION THEREOF. NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, STATE OF COLORADO, that: Section 1. Chapter 15.32 of the Municipal Code of the Town of Avon is hereby repealed and reenacted to read as follows: Chapter 15.32 UNIFORM FIRE CODE Bart- i nnc 15.32.010 Adoption. 15.32.020 Additions and modifications. 15.32.030 Section 11.201(d) amended--Accumulation of Waste Material. 15.32.040 Section 11.207 amended--Combustible Storage in Attic Spaces. 15.32.050 Section 32.101 amended--Permits. 15.32.060 Section 10.306(f-1) added--Fire Alarm System. 15.32.070 Section 10.312 amended--Building Under Construction 15.32.080 Section 10.301(d) amended--Timing of Installation 15.32.090 Violation. 15.32.100 Penalty. 15.32.010 Adoption. A. Pursuant to Section 6.9 of the Charter of the Town, there is adopted, for the purpose of providing minimum standards to safeguard life or limb, health, property and public welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location and maintenance of all buildings, structures and utilities within the Town, the following code: 1. The Uniform Fire Code, 1985 Edition, published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California 90601, and the Western Fire Chiefs Association, 5360 South Workman Mill Road, Whittier, California 90601. B. Three copies of said Code are filed in the office of the Town Clerk and may be inspected during regular business hours. • 0 The same are adopted as if set out at length save and except the following sections which are declared to be inapplicable to the Town and are therefore expressly deleted from the Uniform Fire Code, 1985 Edition: 1. Part I Administrative. All of Article 1 - Title, Intent and Scope. 2. Part I Administrative. All of Article 2 - Organization, Authority, Duties and Procedures. 3. Part I - Administrative. All of Article 4. - Permits. 4. Part III - General Provisions for Fire Safety. Article 10. Fire Protection Sections 10.207, 10.301(c) - paragraphs 1 and 3 (only), 11.208, 11.209 and 13.102. 5. Part IV - Special Occupancy Uses Article 25. Places of Assembly Sections 25.101, 25.102(a), 25.104, 25.108(c), 25.115, 25.116 and 25.401. All of Article 27. Cellulose Nitrate, Plastics, Storage and Handling. Article 28. Storage and Handling of combustible Fibers. Section 28.105. All of Article 35. Covered Mall Buildings. 6. Part VII - Special Subjects. All of Article 87 - Fire Safety during Construction, Alterations or Demolition of a Building. 7. Part VIII - Appendices. All except I-C, III-A, III-C, VI-C and VI -D. 15.32.020 Additions and Modifications. The adoption of the Uniform Fire Code, 1985 Edition (UFC) is subject to the additions and modifications in Sections 15.32.030 through 15.32.080. 15.32.030 Section 11.201(d) Amended - Accumulation of Waste Material. Section 11.201(d) is amended to read as follows: • • Commercial dumpsters and containers with an individual capacity of 1.5 cubic yards or greater shall not be stored or placed within 20 feet of any habitable building hereafter constructed. Exception: Areas containing dumpsters or containers protected by an approved automatic sprinkler system. 15.32.040 Section 11.207 Amended - Combustible Storage in Attic Spaces. Section 11.207 is amended to read as follows: Combustible material shall not be stored in attic areas or similar spaces of business, commercial, industrial or institutional occupancies. Exceptions: 1. when walls, floors and ceiling forming the storage area are protected on the attic room side as required for one-hour fire-resistive construction. 2. In single family duplex, triplex and four-plex residential dwellings. 15.32.050 Section 32.101 Amended - Permits. The title of Section 32.101 is amended to read as "Scope" and further said section is amended to read as follows: This article applies to the erecting or operating of a tent or tents, an air-supported structure or structures that cover a total area in excess of 3,000 square feet. 15.32.060 Section 10.306(f) through (1) Added - Fire Alarm System. Section 10.306(f) through (1) is hereby added to read as follows: (f) Fire Alarm Systems: All fire alarm systems and automatic building-wide fire extinguishing systems are to be supervised (monitored). This must be accomplished through private alarm monitoring companies selected by the building owner or developer. The name of the monitoring company to be used must be submitted to the Fire Department for approval. (g) Central Building Fire Alarm Systems: The central building fire alarm system type shall be non-coded continuous ring, locking zone annunciated. zoning shall be per floor, per stair access, and/or per use area on the floor; i.e., • E (kitchen, cafe/banquet, retail, trash collection point, etc.) or for Fire Department approved alternatives and for precise Fire Department response as approved by the Fire Chief. Separate annunciation shall be required for each sprinkler flow and each supply and return duct system of air handling units over 2,000 cfm or recognized alternative. The control panel, annunciation panel and remote annunciation shall be located as directed by the Fire Department. All access to the fire alarm panel shall be controlled by the Fire Department. The fire alarm panel shall be capable of individual zone disconnection, except for water flow devices where disconnection will not be allowed. (h) Manual Fire Alarms: Manual fire alarm stations shall be of the double acting type approved by the Fire Department. (i) Thermal Detector Application: Thermal detectors shall be located in mechanical rooms, commercial kitchens, locker areas, trash chutes, and public restrooms. (j) Common Area Alarms: System area smoke detectors shall be located in all common areas, at top of stairs, hallways, and shafts (elevator and dumb waiter). (k) Elevator Alarms: Smoke/thermal detectors shall be located in elevator equipment rooms, electric equipment rooms, elevator lobbies, and storage areas opening into corridors. Elevator lobby detectors shall be located per U.B.C., powered from the fire alarm control panel, and contain an electrical contact (Form C) for elevator recall. (1) Commercial Kitchen Extinguishing System Alarm: Activation of a range hood extinguishing system will activate the central building alarm system; if an alarm system is installed. 15.32.070 Section 10.312 Amended - Building Under Construction. follows: Section 10.312 is hereby amended to read as The Chief may designate the number and type of fire extinguishers to be provided for all buildings under construction. The travel distance to any fire extinguisher on any floor shall be • 0 a maximum of 75 feet. The type of fire extinguisher shall be suitable for fire associated with the hazard present. 15.32.080 Section 10.301(d) Amended - Timing of Installation. Section 10.301(d) is hereby amended to read as follows: (d) Timing of Installation. When fire protection facilities are installed by the developer, such facilities including all surface access roads shall be installed and made serviceable during the time of construction. When alternate methods of protection, as approved by the chief, are provided, the above may be modified or waived. 15.32.090 Violation. The following clause concerning violations is hereby set forth in full and adopted with reference to all of the Codes and Standards named in the title of this Chapter: It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the Town of Avon or cause or permit the same to be done, contrary to or in violation of any of the Codes or Standards named in the title of this Ordinance. 15.32.100 Penalty. Any person, firm or corporation violating any of the provisions of any of the Codes or Standards named in the title of this Chapter shall be deemed guilty of a misdemeanor, and any such person, firm or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of any of the Codes or Standards named in the title of this Chapter is committed, continued or permitted and upon conviction of any such violation, such person, firm or corporation shall be punished by a fine of not more than five hundred dollars or by imprisonment for not more than ninety days, or by both such fine and imprisonment. Section 2. Saving Clause. If any part, section, subsection, sentence, clause or phrase of this Ordinance or any of the Codes or Standards adopted hereby are for any reason held to • be invalid, such decisions shall not affect the validity of the remaining sections of this ordinance or any of the Codes or Standards adopted hereby; the Town Council hereby declares that it would have passed this ordinance and adopted the Codes and Standards named in the title hereto in each part, section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared to be invalid.
