No. 1986-08• TOWN OF AVON C ORDINANCE NO. 86-8 SERIES OF 1986 AN ORDINANCE AMENDING SECTION 15.04.810 AND SECTION 15.12.010 OF THE AVON MUNICIPAL CODE AND PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY; REGULATING FEES AND REGULATING THE INSTALLATIONS, ALTERATIONS, REPAIR AND MAINTENANCE OF ELECTRIC CONDUCTORS AND EQUIPMENT WITHIN OR ON PUBLIC AND PRIVATE BUILDINGS AND OTHER PREMISES IN THE TOWN OF AVON; DEFINING CERTAIN TERMS; ESTABLISHING FUNDAMENTAL SAFEGUARDS AND EXAMINATION OF EQUIPMENT FOR SAFETY; ADOPTING BY REFERENCE THE 1984 EDITION OF THE "NATIONAL ELECTRICAL CODE" AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, as follows: Section 1. Amendment. Section 15.04.810 of Chapter 15.04, Title 15 of the Avon Municipal Code is amended to read as follows: 15.04.810 Table No. 3-B - Electrical Permit Fees TABLE NO. 3-B - ELECTRICAL PERMIT FEFS RESIDENTIAL: This includes modular homes, mobile homes and travel trailers, also duplexes and condominiums; construction and extensive remodeling and additions to,-(based on enclosed living area.) Not more than 1,000 square feet $40.00 Over 1,000 square feet and not more than 1,500 square feet $65.00 Over 1,500 square feet and not more than 2,000 square feet $75.00 Per 100 square feet in excess of 2,000 square feet $ 3.00 All other fees, except for inspection in mobile homes and travel trailer parks, shall be computed on the dollar value of the electrical installations, including fixtures and installation costs thereof, and such fees shall be as follows: VALUATION OF WORK (ACTUAL COST TO CUSTOMER): Not more than $300.00 $36.00 More than $300.00 but not more than $2,000.00 $45.00 More than $2,000.00 Mobile homes and travel trailer parks per space Reinspections on all the above under provisions of Section 15.04.570 $45.00 for the first $2,000.00 plus $16.00 for each additional $1,000.00 valuation or fraction thereof. $36.00 $30.00 per each Temporary power inspections $30.00 per each Section 2. Amendment. Section 15.12.010 of Chapter 15.12, Title 15 of the Avon Municipal Code is amended to read as follows: 15.12.010 Adoption. Pursuant to Section 6.9 of the Charter of the Tovn of Avon, there is adopted by reference the National Electrical Code of the National Fire Protection Association, Batterymarch Park, Quincy, Massachusetts, 02269, 1984 Edition. Three (3) copies are now filed in the office of the Clerk of the Town of Avon, Colorado, and may be inspected during regular business hours. The above Code is being adopted as if set out at length. Section 3. Amendment. Paragraph B, Section 15.12.020, of Chapter 15.12, Title 15 of the Avon Municipal Code is amended as follows: 1981 Edition amended to read 1984 Edition. Section 4. Violations and Penalties. a. Violations. The following clause concerning violations is hereby set forth in full and adopted with reference to all of the Codes and Standards named in the title of this Ordinance: It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or.maintain any building or structure in the Town of Avon or cause or permit the same to be done, contrary to or in violation of any of the provisions of any of the Codes or Standards named in the title of this Ordinance. b. Penalties. Any person, firm or corporation violating any of the provisions of any of the Codes or Standards named in the title of this Ordinance shall be deemed guilty of a misdemeanor, and any such person, firm or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of any of the Codes or Standards named in the title of this Ordinance is committed, continued or permitted, and upon conviction -2- 0 • of any such violation, such person, firm or corporation shall be punished by a fine of not more than $500.00 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. Section 5. Saving Clause. If any part, section, sub- section, sentence, clause or phrase of this Ordinance or any of the Codes or Standards adopted hereby are for any reason held to be invalid, such decisions shall not affect the validity of the remaining sections of this Ordinance of any of the Codes or Standards adopted hereby; the Town Council hereby declares that it would have passed this Ordinance and adopted the Codes and Standards named in the title hereto in each part, section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared to be invalid.
