ORDINANCE NO. 85-15
AN ORDINANCE AMENDING CHAPTER 17.22
OF THE MUNICIPAL CODE OF-THE TOWN OF
AVON TO LIMIT FIREPLACES IN CONNECTION
WITH FRACTIONALIZATION
WHEREAS, the Town Council of the Town of Avon
hereby finds and determines that the fractionalization
process, by permitting a greater number of residential units
within the town, has an impact on the number of fireplaces
within the Town and therefore on air pollution within the-
Town;
NOW THEREFORE BE IT ORDAINED-BY THE TOWN COUNCIL
OF THE - TOWN OF AVON-,,,COLORADO:
1. Amendment. Chapter 17.22 of Title 17,
Municipal Code of the Town of Avon, ~is'amended by the
addition of asection 17.22.030 as follows.
"17.22.030 Limitation on wood burning fireplaces
and stoves. If a residential development right is
fractionalized.so as to permit the construction of more than
one living unit, no more than two of any combination of wood
burning fireplaces or stoves shall be allowed in connection
with that development right."

and a public hearing on this Ordinance shall be held at the
regular meeting of the Town:Council of the Town of Avon,
Colorado, on the 10th day of September- , 1985 at
7:30 P.M. in the Municipal Building of the Town of Avon,
Colorado.

BENCHMARK ROAD, AVON, COLORADO FOR THE PURPOSE OF CONSIDERING
THE ADOPTION OF ORDINANCE 85-15, SERIES OF 1985:
AN ORDINANCE AMENDING CHAPTER 17.22 OF THE MUNICIPAL CODE OF THE
TOWN OF AVON TO LIMIT FIREPLACES IN CONNECTION WITH FRACTIONALIZATION
A copy of said ordinance is attached hereto and is also on file
at the office of the Town Clerk and may be inspected during
regular business hours.
Following this hearing, the Council may consider final passage
of this ordinance.
