ORDINANCE NO. ##83-3
AN ORDINANCE AMENDING SECTION 3.12.070.B. OF
THE MUNICIPAL CODE OF THE TOWN OF AVON
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON, AS FOLLOWS:
Section 1. Amendment. Section 3.12.070.B. of the
Municipal Code of the Town of Avon is repealed and
re-enacted as follows:
3.12.070.B. A failure by the town manager to act
upon the application within ten business days after
receipt of the application shall be conclusively deemed to
constitute approval of such application. Any person whose
claim of exemption is denied may, within thirty days of
transmittal of the decision of the town manager, appeal to
the town council for a determination of such exemption and
such appeal shall be considered by the town council within
thirty days of the first regular town council meeting
subsequent to receipt of the appeal. A failure by the town
council to hear and decide the matter within thirty days of
the first regular town council meeting subsequent to receipt
of the appeal shall operate as a decision favorable to the
party appealing.
