ORDINANCE NO.-#82-11

AN ORDINANCE AMENDING CHAPTER-16.52 OF
THE MUNICIPAL CODE OF THE TOWN OF AVON
BY REPEAL AND RE-ENACTMENT OF THE
PENALTY PROVISION THEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON, AS FOLLOWS:
Section 1. Amendment. Section 16.52.020 of
Chapter.16.52, Title 16 of the Municipal Code of the Town of
Avon is repealed and re-enacted as follows:
16.52.020 Violation-=-Penalty. It is unlawful
for any person, firm or.corporatioh to violate any of
the provisions of this chapter or to transfer, sell-,
-lease or-agree to sell or lease, any lot, tract,
parcel, -site, -separate interest (including a leasehold
interest), interest in common, condominium interest,
time-share estate, fractional fee, or any other
division within a subdivision within the town until
such subdivision has been approved in writing'by the
town council and a plat thereof recorded in the office
of the Eagle County clerk and, recorder; Ipr-ovided,
however, that a written. agreement to sell or lease
which is expressly conditioned upon-full compli-ance by
the seller with the subdivision regulations of the town
within a specified period of time and which expressly
recites the seller's failure to satisfy such condition
within such period of time shall terminate the
agreement and entitle the buyer to the prompt return of
all consideration heretofore paid by the buyer under
such agreement, shall not constitute a violation of
this subsection, so long as the project as to which-the
agreement relates has been approved by the town's
Design Review Board.
INTRODUCED, PASSED ON FIRST READING=, APPROVED AND ORDERED
POSTED, THIS 13TH day of APRIL , 1982
and a public hearing on this Ordinance shall be held at'the
regular meeting of the Town Council of the Town of Avon,
Colorado, on-the 27TH day of APRIL , 1982, at
7:30 P.M. in the Munal Building of the Town of Avon,

THE PURPOSE,OF CONSIDERING= ADOPTION OF ORDINANCE NO.#82-11, SERIES
OF1982-
AN ORDINANCE AMENDING CHAPTER 16.52 OF THE MUNICIPAL CODE OF THE TOWN
OF AVON BY REPEAL AND RE-ENACTMENT OF THE.PENALTY PROVISION_THEREOF.
A copy of said Ordinance is attached hereto and is also on file at the
office of the Town Clerk and may be inspected during regular business
hours.
Following this hearing, the Council may consider final passage of-the
Ordinance.
This notice given,and passed by order of the Town Council of the Town of
Avon, Colorado.
